33-12 · Fire Drills
Counselor observed that there is an electronic child check-in system at the front entrance. While Counselor was standing in the entrance, the Counselor observed a parent was dropping off one of her children. The Director then reminded the parent to check in there child, however, parent stated she "had no idea what her code even was". Counselor observed there were no attendance records in the classroom. Counselor asked a staff member if she has an attendance record and she stated no. Counselor then asked the teacher how she accounts for children if there is a fire drill. Staff member stated: she "knows who is attending that day because she can tell by the backpacks" and pointed to backpacks hanging on hooks. Counselor then asked Assistant Director what the procedure is for accounting for children during an emergency drill. Assistant Director stated that she counts the children when they line up to evacuate and then she counts the children after they are outside. Counselor asked the Director for the attendance records. Director stated that attendance is electronic and she will have to figure out how to produce that record. This occurred at approximately 8:35 am on January 20, 2023. Counselor asked that the attendance records be sent via email to the office. As of January 23, 2023, the Director still has not submitted the attendance record

Counselor observed 9 children with 1 teacher in the Ladybug classroom at approximately 10:30 am.. Counselor requested the Director provide the enrollment records for the Ladybug Classroom. The records indicated that there were children in that classroom who were born in April 2021 and June 2021. The DCF Regulation states that a ratio of 1 staff member per 6 children be maintained when there are children over 1 year old but under 2 years old. Counselor returned to the facility in the afternoon on the same day at approximately 4:30 pm. Counselor observed the Director was working in the front office. Counselor once again observed 9 children with 1 teacher in the Ladybug classroom .Counselor advised the Director that the Ladybug classroom was not in compliance with the ratio regulation. Director stated that she would work in that classroom in order to be in compliance. 2.3 Ratios The staff-to-child ratio, as established in Section 402.305(4), F.S., is based on primary responsibility for the direct supervision of children and applies at all times while children are in care. 2.3.1 Mixed Age Groups A. In groups of mixed age ranges, where children under one year of age are included, one child care personnel must be responsible for no more than four children of any age group, at all times. B. In groups of mixed age ranges, where children one year of age but under two years of age are included, one child care personnel must be responsible for no more than six children of any age group, at all times

Counselor observed 63 children on the playground. The capacity for the playground is 60.This was confirmed by the Assistant Director who stated: • The 5 year old classroom had 19 children with 1 teacher. • The 4 to 5 year old classroom had 18 children with 1 teacher. • The 3 to 4 year old classroom had 26 children with 2 teachers. The DCF Child Care Facility Handbook states: 3.4.4 Outdoor Square Footage The play area must be sufficient and safe to allow freedom of movement without collisions among active children. Children benefit from being outside as much as possible, and it is important to provide sufficient outdoor space to accommodate them. A. There must be a minimum of 45 square feet of usable, safe, and sanitary outdoor play area per child, one year of age and older. At a minimum, the outside play area must be able to accommodate one-half of the licensed capacity of the program. B. For the purposes of a licensed urban child care facility, an additional minimum of 45 square feet of usable indoor play space for 25% of the licensed capacity shall be substituted for outdoor play space. The urban child care facility must provide this additional indoor space with equipment that provides physical activity appropriate to the age of the children. C. Based on the outdoor square footage, the total number of children using the play area may not exceed the outdoor capacity. D. For Indoor Recreational Facilities or facilities that provide only evening child care, outdoor play space is not required provided an open area within the existing indoor space is designated and available for play that promotes the development of gross motor skills
