The following non-compliance, unrelated to the complaint allegation was observed; Upon arrival, 11 children in the mixed group of 1s and 2s was observed without adult supervision. The teacher that was sitting at the doorway of her classroom, across the hallway, said that she was watching both classrooms. This is the second occurrence for this class 1 non-compliance and a Notice Of Violation is being issued. Previous non-compliance was issued on 2/19/2025

Complaint alleges that on Monday, August 4, 2025, a school age child was physically mistreated while in the care of this facility. "The incident involved a staff member known as teacher A, who placed her hands around my child's neck and dragged her out of the classroom. This alarming act was witnessed by other staff members, including teacher B and another teacher". A complaint inspection was conducted on 8/11/2025 and the following statements were received : Director and teacher A,B & Volunteer. Per director, that night of 8/4/2025, she got a call from the mom and told her that the child said that the admin assistant chocked her until she was almost out of breath. Child is 10 and is verbal. The day in question a volunteer was with the school age group. Usually, there is a therapist in the room that would have seen the incident but she wasn't there that day. Teacher B was in the building but she was doing other duties so she did not see the incident. Per teacher B, it was the ending of breakfast, going into lunch. After breakfast she cleans up and gets ready for lunch. When it happened, it happened in the open space near the lobby area. She didn't see anything and only heard the child saying don't touch me!, (several times).Per the volunteer, she did not see the admin. assistant put her hands on the child's neck. Per volunteer, she asked the child to put her head up several times. The child refused to do so, so teacher A came in the room and asked her to put her head up. She didn't see her put her hands on the child. She returned about 5 or 6 minutes later and returned to the group. Teacher A denied the allegations and said the child was snatching and jerking so she grabbed her arms to protect herself. Her hands never went near the child's neck. VIDEO FOOTAGE: on 8/4/2025 at around 8:20AM the following was recorded; The child is observed with her head down on the table. Teacher A approached her and pulled her to sit up by the the shoulder. The child lays her head back down and the teacher quickly pulled her back up from behind by pulling on her left shoulder. The child is sitting on a chair, now resting her head on her right hand. The teacher is seen pointing toward the hallway. Since the child did not get up, the teacher grabbed her arm and attempted to pull her up out of her seat, at which point the chair is dragged out of its position. The child pulled her arm back, stood up, and is observed talking back to the teacher. The teacher then grabbed the child by her biceps with both hands and begins to shove the child back toward the hallway. At this point, the child seems to hit a door knob as she is being pushed back. The teacher continues to push her back and her hand placement is no longer visible on the camera as they are walking away from the camera. Her arms appear raised, but the location of where her hands are placed is not visible. She pushes her until the end of the hallway and has the child against the wall. There appears to be a struggle as the door they are standing near opens up twice and the light switch is turned on and back off. Shortly after, the teacher comes back into the main area. A second incident is seen on camera where the same teacher grabbed a child and attempted to force him to sit on her lap. The child is seen struggling to get away but she grabbed his arm and would not let go. She can be seen pinning him down between her knees She pulled him up, placed him on her lap and made a quick motion toward his ear, appeared to either bite or yell in his ear. The child is seen flinching his head away and then placed his hand over his ear. This child was held against his will for a little over two minutes until another teacher walked by and he was let go. Complaint is partly substantiated. Her actions observed in the videos with 2 different children are considered inappropriate discipline. A class 1 non-compliance and NOV is being issued
