07-02 · Background Screening Requirements FDCH/LFCCH Handbook
License Specialist observed that the required background screening was missing for an adult household member living on the premises. Technical Assistance was given to the Operator as per 402.313(3) F.S. and Family Day Care Home / Large Family Child Care Home Handbook that ( Operators, household members (adults and children 12 to 17 years of age), substitutes, volunteers and Large Family Child Care Home employees must have a level 2 background screening clearance from the Department prior to obtaining a license, residing in the home, employment, or volunteering unsupervised with children. The employer/owner/operator must review each employment application to assess the relevancy of any issue uncovered by the complete background screening, including any arrest, pending criminal charge, or conviction, and must use this information in employment decisions in accordance with state laws. Level 2 screening as outlined in s 435.04, F.S., is required for all child care personnel and includes a criminal records check (both national and statewide), a sexual predator and sexual offender registry search, and child abuse and neglect history of any state in which an individual resided during the preceding 5 years. All fingerprints must be submitted and processed through the Background Screening Clearinghouse and herefore a LiveScan vendor that is Clearinghouse compatible must be used for submission of fingerprints. Household members aged 12 to 17 years must complete a Juvenile Records Check with FDLE. 15-02 · Outdoor Time, Fencing, and Play Area Requirements FDCH/LFCCH Handbook
License Specialist observed that the outdoor play area was not in good repair. White Dura Fence (gate) to the right of the playground, next to the outdoor children's bathroom contains exposed hinges with sharp and jagged edges on the fence planks exposed to the children in care. Pinch guard missing to cover exposed hinges. Technical Assistance was given to the Operator as per the LFCCH Handbook that ( Outdoor Play areas shall be clean, in good repair and free from litter, nails, glass, and other hazards. The outdoor play areas must be enclosed with fencing or walls a minimum of 4 feet in height. The fence must not prevent the supervision of children. The fence must be in good condition and conform to applicable local building codes. These areas must have at least two exits, with at least one being remote from the home. All homes in which the property borders a public road/street or laned road/street with public access with a speed limit of 25 miles per hour or greater, including those providing evening care, must maintain safe and adequate fencing or walls a minimum of four feet in height around the outdoor play area. Fencing, including gates, must be continuous, and shall not have opening or gaps larger than 3 1/2 inches that would allow children to exit the outdoor play area. The bottom or base of the fence must remain at ground level and free from erosion or buildup to prevent inside or outside access by children or animals. Maintenance shall include checks at least every month of all supports above and below the ground, all connectors, and moving parts. Documentation must be maintained for a 12-month period. All equipment, fences, and objects on the homes premises shall be free from sharp, broken and jagged edges and properly placed to prevent overcrowding or safety hazards in any one area. )
