04-02 · Supervision
The Licensing Specialist observed that a one-year-old child was not adequately supervised and was able to exit through the back door of the childcare facility, leaving the playground area. The child then walked from the back of the WMS building, where trees and foliage are present, to the front of the facility, past a retention pond, and into the street. A car was driving through the strip mall area at the time, and an unidentified Good Samaritan was able to pick up the child from the street. The daycares location near a heavily trafficked street raised significant concerns about the childs safety in such an environment. The Florida Handbook states the following: 2.4.1, A B D, G and I. A. Childcare personnel must position themselves in the outdoor play area so that all children can be observed and directly supervised. B. Childcare personnel must be assigned to provide direct supervision to a specific group of children and be with that group of children at all times. Children must never be left without childcare personnel supervision inside or outside the facility, in a vehicle, or at a field trip location. D. At all times, lighting must allow childcare personnel to see and supervise children while in care. G. In addition to the number of childcare personnel required to meet the staff-to child ratio, one additional adult must attend field trips away from the childcare facility to help provide direct supervision. The individual could be a parent volunteer as long as that person is under direct and constant supervision of a screened and trained childcare personnel. I. When transporting children in a vehicle or on foot, a telephone or other means of instant communication must be available to childcare personnel. Cellular phones, two-way radio devices, citizen band radios, and other means of instant communications are acceptable. Corrective Action for Inadequate Supervision: Protocol for Exit Doors: All exit doors leading to the outside will be securely locked or equipped with childproof mechanisms to prevent children from leaving unsupervised. A comprehensive review of the building's security protocols will be conducted to ensure that all exit points remain secure during outdoor activities. Transportation Procedures: Accurate attendance logs will be monitored at all times when staff are preparing for transportation to ensure only the required children are leaving the building and boarding the van. Vehicle Supervision: The second staff member designated for transportation duties will actively observe and conduct a thorough vehicle sweep. This staff member will sign the transportation log only after confirming that all children have been accounted for and safely on the van. Any staff member who signs off on the log without physically conducting the vehicle sweep will be considered in violation of the procedure and will be held accountable for fraudulent documentation. Plan of action (POA): Supervision: The director will maintain a log of working hours and, in the event of an absence, must email the Licensing Specialist to notify them. This is in accordance with the requirement that the director must be present at the childcare facility at least 51% of the time. To ensure proper supervision and compliance, the Licensing Specialist will conduct unannounced visits once a month over the next 2-3 months to observe classroom ratios and confirm that children are being adequately supervised. Director will be required to teach ALL STAFF no less than a thirty-minute class about supervision. Sign in sheet will be needed, signatures of all employees that attend and time/date will be required. Although not required: Licensing Specialist Advise of Communication Protocols All staff should be required to carry a communication device, such as walkie talkie, to maintain constant communication with other staff members in case of an emergency. This will ensure that all childcare personnel are able to promptly respond immediately to any safety concern

On 3/6/2025, during the investigation, the Licensing Specialist observed that the transportation log was signed by a second staff member. However, upon further inquiry, the second staff member admitted that they were not physically present on the van on that day to ensure that all children were accounted for. The second staff member acknowledged signing off on the transportation log without conducting the required visual sweep of the children. The Florida Handbook states in section 2.5.2 F - Transportation Log, that: 3. The transportation log must be signed, dated, and verified immediately, confirming that all children are accounted for and that a visual sweep has been conducted. 4. A second childcare personnel must conduct a second visual sweep, sign, and date the transportation log to verify that all children were accounted for and that the log is complete. Corrective Action: The Licensing Specialist informed the driver and the second person who signed off on the transportation log that, in compliance with the Florida Handbook, the second staff member must be physically present to conduct and verify the visual sweep of the children on the van. The Licensing Specialist reviewed the rules outlined in the Florida Handbook with both employees and the director. All parties agreed to comply with the requirements moving forward. The issue was addressed and resolved at the time of the inspection. Plan of Action: All staff involved in transportation duties will be required to complete Transportation Safety Training by 4/21/2025. Upon completion of the training, the director/owner will send an email to the Licensing Specialist confirming that the training has been successfully completed

46-02 · Daily Attendance
The Licensing Specialist reviewed the morning classroom attendance to have three different attendance sheets however no time was placed. When the Licensing Specialist reviewed the attendance sheet there was no way to monitor an accurate number of children who were in the classroom on 3/6/2025. During the time of the initial complaint investigation the director was unable to provide Licensing Specialist documented number of children that were cared for that morning. The Florida Handbook states the following. 7.5, A Daily Attendance Daily attendance of children must be taken and recorded accurately by the childcare personnel, documenting the time when each child enters and departs the program A. Attendance devices used for the purposes of tracking attendance may be used, but personnel must ensure the accuracy of the documented attendance. Each classroom must have an attendance sheet/class roster for the group of children occupying that space. Attendance sheet/class roster must accompany the childcare personnel and the group of children throughout the day should they leave the classroom. Corrective Action: All staff will be required to maintain a clear and accurate attendance log for every child in their respective classrooms. Each log must include the exact time of each child's arrival. When teachers retrieve their classrooms, they will create a separate attendance log for their individual classroom, ensuring each child is accounted for with a recorded arrival time. Attendance will no longer be taken on multiple, disorganized sheets without clear, accurate timestamps. Compliance will require that each classroom maintain a single, properly formatted attendance sheet that accurately reflects the children in that specific classroom, including the precise time of arrival. Plan of Action (POA): Staff will be trained to ensure adherence to these procedures, and regular checks will be conducted to ensure accurate and timely attendance records. Licensing Specialist will review training at next inspection and documentation must be maintained for licensing's review
