A current attendance record and parent contact information must accompany child care personnel out of the building during a drill or actual evacuation and be used to account for all children. Counselor observed the classroom with 9 children and 2 staff members. It is an open room with mixed age children. Teachers in the classroom were unable to provide a Daily attendance sheet for the children present. This was resolved when the counselor asked the teachers to write down all the children's names and create a sign in sheet for the day. 7.5 Daily Attendance Daily attendance of children must be taken and recorded accurately by the child care personnel, documenting the time when each child enters and departs the program. A. Attendance devices used for the purposes of tracking attendance may be used, but personnel must ensure the accuracy of the documented attendance. Family Services Counselor reviewed 5 camera footage clips that were sent to the counselor from the facility's director in helps of understanding the complaint and allegations. Throughout the video footage, staff is seen leaving children unattended during nap hours. No teacher was within sight and hearing of the children. This was resolved as the staff member is no longer working there. 2.4.2 Nap time Supervision During nap time, child care personnel must be within sight and hearing of all the children. All other child care personnel required to meet the staff-to-child ratio must be within the building on the same floor and available to be summoned if needed to ensure the safety of the children. Counselor observed through video footage, a child care personnel using a ruler to hit children. Child care facility Director stated she had given the former employee a verbal warning after witnessing such acts with a pointer instead. 12-07 · Facility Environment
Child care personnel was observed in a video footage, leaving children unattended. On the rug area was a vacuum plugged in the wall with cords laying in front of a child. A staff member was seen walking into the classroom from the outside parking lot area and trying to vacuum under the child's legs as if to make the child move. The child never moved. Staff continued vacuuming under the child's legs and around the child. The other staff member in the room didn't seem to notice or pay attention to the vacuum on the rug area. Her attention was on the opposite side of the classroom. This was resolved as the activity ended a few minutes later. Vacuum was put away. 3.1 General Health and Safety Requirements A. All child care facilities must be clean, in good repair, free from health and safety hazards and from evidence of, or presence of, vermin infestation. Indoor play areas must be inspected daily for basic health and safety and documented on a daily inspection log. Outdoor play areas must be inspected daily for basic health and safety. Any problems must be corrected before the play area is used by children. Documentation of the indoor play area inspection must be maintained for 12 months. B. It is the responsibility of the director/operator to ensure all areas and equipment of the facility are free from fire hazards, such as lint build up in heating and air vents, filters, exhaust fans, ceiling fans, and dryer vents. This includes grease build-up in ovens, stoves and food equipment. D. Strangulation hazards, strings, and cords long enough to encircle a childs neck such as those on toys and window coverings must not be accessible to children in care. G. Cleaning must not take place while rooms are occupied by children except for general clean-up activities that are part of the daily routine. General cleaning refers to cleaning necessary to maintain a sanitary environment but that does not pose a hazard to children, such as wiping the table after lunch, soaking toys in a tub on the countertop, or sweeping

Counselor observed a child being placed in a portable crib or playpen for nap. The child was too big to be placed in the portable playpen and was observed climbing in and out of the playpen unattended which could have cause bodily harm to the child from a fall. Child was observed being placed in a portable playpen surrounded by multiple blankets and sleeping on top of multiple blankets. A. The Student Health Examination shall be completed by a person given statutory authority to perform health examinations. B. The Student Health Examination or the signed statement is valid for two years from the date the physical was performed. An up-to-date version must be on file for as long as the child is enrolled at the facility. C. If the custodial parents or legal guardians fail to provide the documentation required above within 30 days of enrollment, the facility shall not allow the child to remain in the program. D. School-aged children attending public or non-public schools are not required to have student health examination and immunization records on file at the child care facility as such records are on file at the school where the child is enrolled. E. If the custodial parents or legal guardians need assistance concerning these requirements, the facility shall refer them to the Department of Health or to the childs physician. F. Medical records in this section are the property of the custodial parent or legal guardian and must be returned to them when the child withdraws from the facility. The medical records are transferable if the child attends another facility. G. Any child who has or is at an increased risk for a chronic physical, developmental, behavioral or emotional condition and requires additional services must have a current Emergency Care Plan, prepared by the parent/guardian or physician, included in the childs file and readily accessible for those caring for the child.
