04-11 · Supervision
Teacher H.C. was supervising children while under the influence of narcotics, alcohol, or other drugs that impaired her ability to provide safe child care. Another agent with the Department spent approximately one hour with H.C., both interviewing her and during the drug testing process conducted in compliance with DCF protocols. During this time, Another agent with the Department observed teacher H.C. to be nervous, agitated, and fidgety, in a manner that led another agent with the Department to conclude, based upon her experience and training, that teacher H.C. was acting in a manner consistent with being under the influence of Cocaine, Fentanyl, or similar narcotic. Another agent with the Department review of the classroom surveillance video of August 3 also suggested impairment. When another agent with the Department asked teacher H.C. to submit to a urine drug test on August 4, although teacher H.C. consented, H.C. tried to conceal and falsify her status by presenting another agent with the Department with a cup of tap water. When teacher H.C. did present a cup of urine to be tested, the urine tested positive for Cocaine, Fentanyl, Benzodiazepine, and THC. The presence of these drugs in teacher H.C. system explains her impaired behavior. This was corrected as the staff member H.C. is no longer employed at the daycare terminated on 08/07/23. 2.4 Supervision 2.4.1 General Supervision Requirements A. Child care personnel must position themselves in the outdoor play area so that all children can be observed and directly supervised. B. Child care personnel must be assigned to provide direct supervision to a specific group of children and be with that group of children at all times. Children must never be left without child care personnel supervision inside or outside the facility, in a vehicle, or at a field trip location. C. Supervision standards apply at all times away from the child care facility, including during field trips, outdoor play, and when picking up or dropping off children at designated locations, such as bus stops, school, or a childs home. For school-age children, personnel must know where the children are and what they are doing at all times and capable of responding to emergencies including when children are separated from their group. D. At all times, lighting must allow child care personnel to see and supervise children while in care. E. A program is responsible for the supervision of a child until an authorized individual retrieves the child from the program. A child shall not be released to any person other than the person(s) authorized or in the manner authorized in writing by the custodial parent or legal guardians. All individuals authorized to pick up a child must be identified in writing prior to release by the custodial parent or legal guardian to the program, and the program must verify the individual picking up the child is authorized by using a picture form of identification. Each child transported must be dropped at the designated location as agreed upon by the provider and the custodial parent/legal guardian and released to an authorized individual. F. No person shall be an operator, owner, or employee of a child care facility while using or under the influence of narcotics, alcohol, or other drugs that impair a persons ability to provide safe care and supervision

13-06 · Toxic Substances, Hazardous Materials and Weapons
A 2 year child had access to staff member H.C. backpack and later tested positive for benzodiazepines, which is a medication that staff member H.C. admitted that she takes when she has an anxiety attack. This was corrected at the time of complaint staff member H.C. was terminated for being deceitful to the Owner and Director when questioned about the medication. 3.2 Toxic/Hazardous Material/Firearms/Weapons A. All areas and surfaces accessible to children must be free from toxic substances, bio contaminants, and hazardous materials/equipment/tools, including power tools, plastic bags, matches, candles, lighters, etc. B. All potentially harmful items, including cleaning supplies, flammable products, poisonous, toxic, and hazardous materials, must be labeled and used according to manufacturers recommendation. These items, as well as knives, sharp tools, and other potentially dangerous hazards, must be stored in a locked area or must be inaccessible and out of a childs reach at all times. C. Firearms and weapons, as defined in section 790.001, F.S., are prohibited within any building or upon any person located on the premises, excluding federal, state or local law enforcement officers. D. Narcotics, alcohol, or other impairing drugs/paraphernalia must not be present on the premises or in vehicles used by child care facility

Staff member H.C. attempted to pass off tap water as her urine during the drug test that she was administered during the investigation. This was corrected at the time of investigation in that H.C. did give a urinalysis. 8 Access/Child Safety 8.1 Access A. A child care facility must provide the custodial parent or legal guardian access, in person and by telephone, to the child care facility during the facilitys normal hours of operation or during the time the child is in care. B. The child care facility must not interfere with or prevent the licensing authority from copying records, photographing or recording a location or activity on the premises as documentation for the inspection. 8.2 Child Safety A. Acts or omissions that meet the definition of child abuse or neglect provided in Chapter 39, F.S. or Chapter 827, F.S., constitute a violation of the standards is section 402.301-.319, F.S., and will support imposition of a sanction, as provided in Section 402.310, F.S. B. Failure to perform the duties of a mandatory reporter pursuant to Section 39.201, F.S., constitutes a violation of the standards in Section 402.301-.319, F.S. C. Child care personnel must appropriately interact with children to foster a healthy, safe environment that will encourage the childs physical, intellectual, motor, and social development. 33-03 · Training Requirements
Counselor observed staff member did not have documentation to show child care personnel had begun the introductory training within 90 days of employment in the child care industry during inspection. Staff member has an industry and employment start date of 2/21/2023 at the facility. Staff member should have begun the required training by 05/21/2023. Counselor observed via our training system via computer on 06/02/2023 that staff member failed to start training until 05/24/2023. 4.1 Beginning Training Child care personnel including volunteers who work 10 hours or more per month must begin training within 90 days of employment in the child care industry and successfully complete Departments training within 12 months from the date training begins. Training taken prior to employment in the child care industry does not constitute begin training. The begin training timeframes begin at the time of employment in the child care industry. Training completion may not exceed 15 months from the date of employment in the child are industry in any licensed Florida child care facility. This may be accomplished by classroom attendance in a Department-approved training course, acquiring an educational exemption from a Department-approved training course, beginning a Department-approved online child care training course, or by receiving results from a Department-approved competency examination. The child care program is responsible for obtaining training documentation from child care personnel. 23-02 · Fire Drills
/24/2023 and noticed the staff failed to sign the required signatures proving the staff performed a physical sweep of the entire vehicle from front to back, including all rows, seats and under seats. The staff failed to sign off that no children were left in the vehicle. 2.5.2 Transportation Log A. A log must be maintained for all children being transported in a vehicle or on foot away from and/or to the premises of the child care facility. The log must be retained on file at the facility for a minimum of 12 months and available for review by the licensing authority. The log must include: 1. Each childs name, 2. The date and time of departure, 3. Time of arrival at the destination, 4. The signature of the driver (or in the case of travelling on foot, the signature of the child care personnel), and 5. The signature of a second child care personnel or person(s) authorized by the provider to verify the transportation log and that all children have arrived safely and left the vehicle (if applicable). 33-09 · Training Requirements
Counselor observed a staff member training record which did not include the required Safe Sleep/Shaken Baby Syndrome Training being completed as of inspection date. The staff member started employment with the facility on 3/30/2023. Training was due by 4/30/2023. 4.2.3 Safe Sleep/ Shaken Baby Syndrome Training All child care personnel who work in a facility that offers care to infants must have training regarding guidance on safe sleep practices, preventing shaken baby syndrome and abusive head trauma; recognition of signs and symptoms of shaken baby syndrome and abusive head trauma; strategies for coping with crying, fussing, or distraught child and the development and vulnerabilities of the brain in infancy in early childhood within 30 days of hire at the facility. For child care personnel to satisfy this requirement the training must be accomplished through one of following methods: Department's Health Safety and Nutrition course, Safe Sleep course, or the Early Learning Floridas Safe Sleep Practices. Documentation of training must be maintained on the Department's training transcript in the child care personnel record. Prescription medication must have a label stating the name and contact information of the physician and/or pharmacy, childs name, name of the medication, and medication directions.
