On 3/19/2025 at 11:56 A.M., Licensing Specialist arrived at the facility to commence a complaint received at the Office of Childcare Licensing. During the inspection, Licensing Specialist observed the following nap time ratios: Class 1: 6-1 yr. olds and 1 childcare personnel Class 2: 9-1 yr. olds and 2 childcare personnel Class 3: Mixed age group of 2's, 3's and 4 yr. olds: 20 children in total with 1 childcare personnel Class 4: 6 infants and 1 childcare personnel One additional staff was available at the time inspection. 2.3 Ratios The staff-to-child ratio, as established in Section 402.305(4), F.S., is based on primary responsibility for the direct supervision of children and applies at all times while children are in care. 2.3.1 Mixed Age Groups A. In groups of mixed age ranges, where children under one year of age are included, one child care personnel must be responsible for no more than four children of any age group, at all times. B. In groups of mixed age ranges, where children one year of age but under two years of age are included, one child care personnel must be responsible for no more than six children of any age group, at all times This was resolved at the time of inspection. Provider added an extra teacher into the Infant room. The classroom was back in compliance with standards. There were now 2 childcare personnel with 6 infants. Licensing Specialist returned to the facility on 3/20/35 at 2:55P.M. and observed the following ratios: Class 1: 3 Infants and 1 childcare personnel Class 2: 3 Infants and 1 childcare personnel Class 3: 10-2 yr. olds and 1 childcare personnel Class 4: 17 mixed age children (Ages: 6-5 yr. olds, 5-4 y. olds and 6-3 yr. olds), with 1 childcare personnel Class 5: 6-1 yr. olds and 2 childcare personnel Class 6: 6-1 yr. olds and 1 childcare personnel. 1 additional staff was available at the time of inspection. 04-18 · Supervision
Licensing Specialist interviewed childcare personnel that was working at the facility but has resigned. The former staff stated she worked in the classrooms for about two weeks before going through Background and Finger printing process. She had not had a Level II Background check completed before allowing to work alone with children. A second agent from the Department also interviewed the staff at the facility and stated they thought the former teacher resigned because she couldn't handle a class of just 10 children by herself. Former staff was hired on 3/3/25 and resigned on 3/14/25. Fingerprints and background screening was initiated on 3/13/25. At the time of inspection, results from her fingerprints and background screening were still in process. This has been resolved. The teacher resigned from her position and is no longer working at the facility. 5 Background Screening 5.1 Initial Screening A screening must be conducted as a condition of employment. The employer/owner/operator must review each employment application to assess the relevancy of any issue uncovered by the complete background screening, including any arrest, pending criminal charge, or conviction, and must use this information in employment decisions in accordance with state laws. A. Level 2 screening as outlined in s. 435.04, F.S., is required for all child care personnel and includes a criminal records check (both national and statewide), a sexual predator and sexual offender registry search, and child abuse and neglect history of any state in which an individual resided during the preceding 5 years. All fingerprints must be submitted and processed through the Background Screening Clearinghouse and therefore a LiveScan vendor that is Clearinghouse compatible must be used for submission of fingerprints. 5.2 Re-Screening A screening conducted under this rule is valid for five years, at which time a re-screen must be conducted in the same manner as the initial screening. C. Child care personnel must be re-screened following a break in employment in the child care industry that exceeds 90 days. Child care personnel/individual with a break in service that exceeds 90 days are considered unscreened child care personnel/individuals until completion of re-screening. Licensing Specialist reviewed the current Employee-Contractor Roster for all child care personnel in the Clearinghouse with the facility Director. Initial employment status and any changes in status must be reported within 5 business days. The following childcare personnel had not been added to the roster: L.E. A.G. S.C. L.L. N.F. A.M. A.T. The Director had to call the Regional Manager to get assistance with adding the employees. The center Director had difficulty getting into Background and Screening. She had been working with the Department and was just granted access recently. The person in charge of the Screening results and Background access failed to update the Clearinghouse roster. Licensing Specialist observed the infant room and the toddler 2 yr. old room had cleaning solution accessible to the children. The toddler two classroom had cleaning supplies accessible to the children, placed in the bottom of an unlocked long cabinet, right next to the restroom area. 04-01 · Supervision
Counselor interviewed all 9 staff members during the commencement of an investigation and complaint allegations. During the interviews many areas of concerns and incidents were discovered. Staff and Director confessed that there was interaction between the director's son and children in the facility. Apparently, there was a child this unscreened individual said smelled. The individual then sprayed some type of cologne on the child causing the child to break out and have an allergic reaction to it. The parent complained and terminated their child's enrollment in the process. Multiple witnesses stated this individual would walk around the facility as he wished. Director was aware of the incident and failed to report and document. This was resolved when the parent terminated their child's enrollment. The staff member's employment was terminated. 2.4 Supervision 2.4.1 General Supervision Requirements A. Child care personnel must position themselves in the outdoor play area so that all children can be observed and directly supervised. B. Child care personnel must be assigned to provide direct supervision to a specific group of children and be with that group of children at all times. Children must never be left without child care personnel supervision inside or outside the facility, in a vehicle, or at a field trip location. C. Supervision standards apply at all times away from the child care facility, including during field trips, outdoor play, and when picking up or dropping off children at designated locations, such as bus stops, school, or a childs home. For school-age children, personnel must know where the children are and what they are doing at all times and capable of responding to emergencies including when children are separated from their group. D. At all times, lighting must allow child care personnel to see and supervise children while in care. E. A program is responsible for the supervision of a child until an authorized individual retrieves the child from the program. A child shall not be released to any person other than the person(s) authorized or in the manner authorized in writing by the custodial parent or legal guardians. All individuals authorized to pick up a child must be identified in writing prior to release by the custodial parent or legal guardian to the program, and the program must verify the individual picking up the child is authorized by using a picture form of identification. Each child transported must be dropped at the designated location as agreed upon by the provider and the custodial parent/legal guardian and released to an authorized individual. F. No person shall be an operator, owner, or employee of a child care facility while using or under the influence of narcotics, alcohol, or other drugs that impair a persons ability to provide safe care and supervision. G. 11-03 · Child Discipline
Counselor received a complaint stating a child was injured at the facility. During the investigation, another agent with Department of Children and Families did a well visit on the child and did confirm bruising like marks on their arm. Child stated a staff member from the facility caused the bruising while attempting to get him to nap at nap time. This caused law enforcement officers to commence and investigation. Jacksonville Sherriff's Office did arrest the staff due to the allegations. This is currently an active criminal investigation. During the interviews the counselor conducted with the staff, other allegations of mistreatment of children were exposed. There were other staff members that did not follow the discipline policy. The director gave the counselor a copy of a Coaching Form dated for 10/02/2023, validating the claims made of inappropriate Discipline practices. Counselor received a complaint at the Office of Childcare Licensing. The allegation stated a child was left with bruising after interactions with a staff. Counselor interviewed all 9 staff members at the facility. One staff member was taken under custody by Jacksonville Sheriff Officers. Another agent with The Department of Children and Families did a home visit to the child and saw evidence of bruising. The child was verbal and spoke about the events that led to the bruising. During the staff interviews, there were also allegations of another staff member having inappropriate interaction with children in the toddler class. Staff alleged that a staff member was seen grabbing children by the ankles and swinging them upside down to get them to listen and lay down for naptime. A parent interviewed also stated they noticed their child had bruising around the ankles but did not know where the bruising was coming from. It is unclear if the bruising the parent spoke about was related to the incidents. Counselor expressed the importance of the Child Abuse and Neglect Reporting Requirements to all 9 staff members interviewed. Counselor had interviewed all 9 staff members about the allegations made in the complaint and those allegations brought up during the interview process. During the interview with a specific staff member, it was evident that they withheld information and fraudulently lied about not knowing of facts and complaints brought to them expressing concerns for the welfare and safety of the children in care. The staff member also was fraudulent when indicating that they had documented a statement and met with another staff member concerning incidents in the classroom where other children were involved. The staff member was questioned about the write up and indicated that they had never seen it and never met about any incidents. The report of such meeting was given to the counselor with no signature of the staff that was supposedly spoken to and met with. The person then lied and stated that the staff refused to sign the document. The staff member in which the document was referring to was shown the document and stated they had never received it and was unaware of such document.
