At the time of reinspection, the FSC observed a cleaning supply closet located next to the girls bathroom in the near the VPK B classroom (Rm 117) that was ajar and had cleaning supplies that were on the floor and accessible to the children in care, The closet was not locked, there was no signage to keep the door closed, nor of the hazardous contents of the closet. 3.2 Toxic/Hazardous Material/Firearms/Weapons B. All potentially harmful items, including cleaning supplies, flammable products, poisonous, toxic, and hazardous materials, must be labeled and used according to manufacturers recommendation. These items, as well as knives, sharp tools, and other potentially dangerous hazards, must be stored in a locked area or must be inaccessible and out of a childs reach at all times. At the time of inspection, the FSC reviewed the Emergency Preparedness Drills log. This document showed that the last emergency preparedness drill was conducted on 9/22/22. 3.8.5 Emergency Preparedness B. Lockdown and inclement weather drills shall be conducted a minimum of one time each per operating year when children are in care and the documentation of these drills must be maintained for 12 months from the date of the drill. 12-10 · Technical assistance was given on the general health and safety requirements. 3.1 General Health and Safety Requirements F. Design and construction of a new child care facility or modifications to an existing facility must meet the requirements of the applicable local governing body. The facility must provide current written approval from the local governing body to verify compliance with building requirements, which include construction of a new building; renovation of an older building; or after a natural disaster to properly evaluate and where necessary, remediate or avoid sites wheres childrens health could be compromised. The written approval must include assessments of: 1. Potential air, soil, and water contamination on facility site and outdoor play areas; 2. Potential toxic or hazardous materials in building construction, such as lead and asbestos; and 3. Potential safety hazards in the community surrounding the site
Counselor received a complaint on 6/21/2023, stating the facility had a flooring contractor stripping or waxing the floors. Infants remained in the building despite there being strong fumes. Large amounts of water were visible on the floor and classroom furniture stacked in the hallway blocking part of the emergency exit door at the end of the hallway. Counselor interviewed 7 people and has determined based on eye-witness testimony that the facility had an activity (waxing and stripping of floors), during the facility's operating hours, endangering the health and/or safety of the children in care. Witnesses say the classroom furniture was stacked high, all the way down the right-hand side of the hallway and blocking the emergency EXIT door. The infant room remained open throughout the ordeal (directly next to the room being worked on). Children and staff in the infant room were subject to breathing in strong fumes. The classroom door was left open from the early hours the contractor started until the staff and director were able to bring the furniture inside from outside at the end of the day. There was furniture lined up outside the classroom door being worked on, in addition to the classroom furniture piled up in the hallway. This standard was resolved and brought back to compliance on 6/13/2023, after the facility's director asked the floor contractor to pick up and leave the premises. The facility's director and staff took the furniture down and brought it inside the classroom by the end of the day

46-07 · Daily Attendance
Counselor has spoken to the staff and families during the interviewing process. Counselor has determined that ample evidence from testimonial, states the children were taken and or sent to the cafeteria during the morning drop off due to the floor contractor working in the building. Per the director, the children gathered in the cafeteria as they normally do for breakfast and then were transferred adjacent into the preschool building. When the counselor asked for the sign in sheets from the children that were in the cafeteria, counselor was told that the children were signed in after the transfer and when they entered the other building and into their class Counselor gave technical assistance with daily attendance and records. This standard will be monitored during routine inspections. There was not enough evidence proving the facility was out of compliance with ratio and teacher counts. The provider supplied the sign in and out sheets for the staff present that day and the children present. The counselor counted 5 staff members present and 35 children were present on the day of the incident. Counselor found this standard not in compliance due to the fact that they failed to sign the children in as they were entering the cafeteria area. Documentation was received by provider via e-mail on 2/21/2023 regarding that the cat was still present on the premises of the facility and has not received current vaccination records for the cat. The provider stated that that a former staff member was going to come pick up the cat but has not done so as of reinspection date. Documentation were kept on file. Counselors observed the facility out of ratio during inspection. Counselors observed 12 children total in the mixed age group of 2 and 3 years old (with 8- 2 years old and 4- 3 years old) with 1 staff member, CM. Counselor gave technical assistance from the Florida Statutes: 402.305 Licensing standards; child care facilities. (4) STAFF-TO-CHILDREN RATIO. (a) Minimum standards for the care of children in a licensed child care facility as established by rule of the department must include: 1. For children from birth through 1 year of age, there must be one child care personnel for every four children. 2. For children 1 year of age or older, but under 2 years of age, there must be one child care personnel for every six children. 3. For children 2 years of age or older, but under 3 years of age, there must be one child care personnel for every 11 children. 4. For children 3 years of age or older, but under 4 years of age, there must be one child care personnel for every 15 children. 5. For children 4 years of age or older, but under 5 years of age, there must be one child care personnel for every 20 children. 6. For children 5 years of age or older, there must be one child care personnel for every 25 children. 7. When children 2 years of age and older are in care, the staff-to-children ratio shall be based on the age group with the largest number of children within the group. (b) This subsection does not apply to nonpublic schools and their integral programs as defined in s. 402.3025(2)(d)1. In addition, an individual participating in a community service program activity under s. 445.024(1)(e), or a work experience activity under s. 445.024(1)(f), at a child care facility may not be considered in calculating the staff-to-children ratio. Corrective Action: Counselors, staff member ,CM, and the 12 children walked to the outside of the facilitys building, next to their fenced in outdoor playground. Staff member, JW, was present at that time and moved child #1 at 10:08 AM from 12 children in the mixed age group of 2 and 3 years old to the 2 years old room with staff members AD and LP during inspection. Counselors observed at this time the Mixed age group of 2 and 3 years old with 1 staff member, CM, and 11 children, and 2 years old with staff member AD and LP with 11 children. Counselor observed the class to be walking with an age appropriate ring holding rope around the outside of the facilitys building. The class walked in an oval motion around the inner asphalt road of the campus, onto the sidewalk and back to the facilitys outside door building. Counselor was notified via e-mail on 2/5/2023 that as of 2/3/2023, the facility no longer has an active credentialed director for the facility. The facility was placed on a provisional license for 6 months to obtain an active credentialed director for the facility as of 2/4/2023. Counselor observed one child's medication bottle that had a clear white label on the bottle and a medicine plastic syringe in a gallon zip block bag. Counselor observed the medication white label very closely and could observe that there very faintly and very faded, black ink present, however the label was not legible to read. The facility has continued to give the child the medication based on what was written the medication by the parent. Counselor gave technical assistance during inspection from Child Care Facility Handbook: 6.5 Medication Child care programs are not required to give medication; however, if a program chooses to do so, it must comply with the following requirements: C. Prescription and non-prescription medication brought to the child care facility by the custodial parent or legal guardian must be in the original container. Prescription medication must have a label stating the name and contact information of the physician and/or pharmacy, childs name, name of the medication, and medication directions. All prescription and non-prescription medication must be dispensed according to written directions on the prescription label or printed manufacturers label and maintained at the appropriate temperature. Counselor observed 5 staff members 5 year employment history forms that were not completed at all (no 5 year employment history or reference checks) or did not have a full 5 year employment history and reference checks on file during inspection. Counselor gave technical assistance during inspection from Child Care Facility: 5.1 Initial Screening D. The employer/owner/operator must conduct employment history checks, including documented attempts to contact each employer that employed the individual within the preceding five years, and documentation of the findings. Documentation must include the applicants job title and description of his/her regular duties, confirmation of employment dates, and level of job performance. The employer/owner/operator must make at least three attempts to obtain employment history information. Failed attempts to obtain employment history must be documented in the personnel file and include date, time, and the reason the information was not obtained. Counselor determined through evidence and testimony that on 1/9/2023, the facility had 1 staff member caring for a total of 14 children with a mixed age group of 1,2,3,4 and 5 years old starting at 6:49 AM until 7:23 AM when a second staff member arrived. Upon arrival to the facility, counselor observed the following ratio: • 2 years old- 2 staff; 13 children • 2 years old- 2 staff;11 children • Infants- 6 staff (3 child care personnel and 3 volunteers) 7 children • Mixed 3 and 4 years old- 1 staff; 12 children ( There were 3- 3 years old and 9- 4 years old) • Mixed age group of 4 and 5 years old- 2 staff; 14 children (There were 8- 4 years old and 6- 5 years old) • Mixed age group of 3 and 4 years old- 2 staff; 11 children (There were 10- 3 years old and 1- 5 year old) • Mixed age group of 1 and 2 years old- 2 staff; 12 children (There were 10- 1 years old and 2-2 years old) • Mixed age group of 4 and 5 years old- 2 staff; 16 children (There were 12- 4 years old and 4- 5 years old) • Mixed age group of 4 and 5 years old- 2 staff; 15 children (There were 11- 4 years old and 4- 5 years old) • 4 additional staff members Counselor gave technical assistance from the Florida Statute: 402.305 Licensing standards; child care facilities. (4) STAFF-TO-CHILDREN RATIO. (a) Minimum standards for the care of children in a licensed child care facility as established by rule of the department must include: 1. For children from birth through 1 year of age, there must be one child care personnel for every four children. 2. For children 1 year of age or older, but under 2 years of age, there must be one child care personnel for every six children. 3. For children 2 years of age or older, but under 3 years of age, there must be one child care personnel for every 11 children. 4. For children 3 years of age or older, but under 4 years of age, there must be one child care personnel for every 15 children. 5. For children 4 years of age or older, but under 5 years of age, there must be one child care personnel for every 20 children. 6. For children 5 years of age or older, there must be one child care personnel for every 25 children. 7. When children 2 years of age and older are in care, the staff-to-children ratio shall be based on the age group with the largest number of children within the group. Corrective Action: The facility was in ratio during on-site inspection and observed ratio in compliance prior to receiving the allegation. On 1/9/2023 the facility was observed via attendance records to be back in ratio at 7:23 AM, therefore the standard was corrected at the time of inspection
