33-05 · Training Requirements
Specialist observed a personnel K.L who had started the industry in 2.20.24 and left in 2.15.2025. The personnel had not completed her 45 hours training within the first year of employment. K.L had returned 3.21.2025 and still had not had completed the 45 hour training. 4.3 Break in Service [...] B. In the event an individual leaves the child care industry not in compliance with the training requirements and returns to the industry either at the same or a different child care facility, he or she must comply with the training requirements described in this section, as well as any new training requirements that may have been added during the gap in employment in the child care industry prior to re- employment. Facility made the decision to terminate K.L until her training is completed, resolving at time of inspection. Specialist notes that K.L will need to test out of the 45 hours and 5-Hour ELC Training before returning as child care personnel

45-03 · Technical assistance was provided regarding the importance of ensuring all personnel have the appropriate Level II BGS prior to having contact with vulnerable persons. Level II BGS standards are established in s. 435.04, F.S. and if the employee has a disqualifying offense per s. 435.06(2)(a), F.S., then they are not eligible for hire. According to s. 435.06(2)(a): "An employer may not hire, select, or otherwise allow an employee to have contact with any vulnerable person that would place the employee in a role that requires background screening until the screening process is completed and demonstrates the absence of any grounds for the denial or termination of employment. If the screening process shows any grounds for the denial or termination of employment, the employer may not hire, select, or otherwise allow the employee to have contact with any vulnerable person that would place the employee in a role that requires background screening unless the employee is granted an exemption for the disqualification by the agency as provided under s. 435.07."
The investigation revealed that the program hired an individual for the role of Teacher's Assistant despite the individual having a disqualified BGS. The individual listed on the Supplemental Inspection Sheet was hired for training on 11/12/2025; while training, the individual was allowed access to the children in the child care program. The individual was employed for 27 days before their resignation on January 4, 2025. For the duration of the individual's employment, their BGS remained in the not eligible status. Though the individual was going through the Exemption from Disqualification process for BGS, they were not eligible for employment during the appeal process. It was noted during the investigation that the individual was never permitted to be alone or have unsupervised contact with children. The standard was brought back into compliance when the disqualified individual resigned from the program; completed at time of inspection
