39-03 · Accident/ Incident Notification and Documentation

Upon inspection, the Family Service Counselor (FSC) observed documentation of health and safety checks of each child in the classroom dated 2/5/2024; however, one of the children the staff documented to have observable injuries did not have an incident report on 2/5/2024. The FSC gave the following TA from the Florida State Statute. 6.4 Accident/Incident Notification A. All accidents and incidents or unusual occurrences that threaten a child's health, safety, or welfare while the child is in care must be documented on the same day they occur. B. This documentation must be shared with the custodial parent or legal guardian on the date of occurrence. C. Documentation must include the name of the affected party, date and time of the occurrence, description of the occurrence, actions taken and by whom, and appropriate signatures of program childcare personnel and the custodial parent or legal guardian. Program childcare personnel signatures may include the director/childcare personnel who witnessed the incident, who were involved in the incident, and/or who responded to the childs needs. Corrected Action A corrective action measure is not applicable because the child is no longer attending this daycare, and the incident/accident report cannot be signed. However, the FSC did provide considerable TA to owner/director/staff about informing parents of any incident or accidents that staff/employees notice may occur. TA provided by FSC was that if they see a mark or injury on any child, they are to complete an Incident/Accident report for the parent to sign. The daycare facility is responsible for complying with the following Florida Statute above. "See something, say something."
