44-02 · Background Screening Documents
Licensing Specialist could not observe one staff members background screening clearance letter on file during inspection. Licensing Specialist observed, via her computer during inspection, the one staff members background screening prints retention date with an expiration date of 8/10/2023 and under DCF Child Care the eligibility determination stated A New Screening is Required. Licensing Specialist gave technical assistance from the School Readiness Handbook, 2.1 Health and Safety & the School-Aged Child Care Facility Handbook: 7.4.1 Background Screening Documents Background screening documentation must be maintained for all child care personnel as defined by Section 402.302(3), F.S., which includes household members if the facility is located in or adjacent to the home of the operator. Background screening documentation must be on-site and available for the licensing authority to review. C. A copy of the eligible results, for the Level 2 screening, generated from the Clearinghouse must be on record for each personnel. If awaiting Out-of-State criminal history results, a copy of the DCF email informing of the individuals eligibility for a provisional hire status must be in the personnel file. Corrective Action: The facility is to initiate a new background screening for the one staff member to be fingerprinted for background screening. The provider is to submit to Licensing Specialist proof that the one staff member was initiated by the provider for a new background screening. The provider is to submit proof to Licensing Specialist via e-mail. ***The staff member will not be able to work at the facility until background screening clearance letter results state under DCF Child Care with a status of eligible with the date she became eligible

At the time of inspection, staff files were missing application for employment. 7.4 Personnel Records Records must be maintained and kept current on all childcare personnel, as defined by Section 402.302(3), F.S. These records shall be on-site, available for review by the licensing authority and must include: A. A complete employment application with the required statement pursuant to Section 402.3055(1)(b), F.S. B. Documentation of position and date of employment. C. CF-FSP Form 5337, Child Abuse & Neglect Reporting Requirements, which is incorporated by reference in 65C-22.001(7)(l), F.A.C., must be signed on or before hire date and annually thereafter by all childcare personnel. D. Copies of training information and credentials as applicable. F. Prior to beginning volunteering in a child care facility, a CF-FSP 5217, Volunteer Acknowledgment which is incorporated by reference in 65C-22.001(7)(e), F.A.C., and may be obtained from the Departments website www.myflfamilies.com/childcare, must be completed and on file at the child care facility for the volunteer. Written documentation of volunteer hours must be maintained at the facility for a minimum of 12 months and available for review by the licensing authority. An outline of a staff file was shared with the provider via email, containing samples of the required documents to ensure the information and accessibility is available for new/ returning staff. Staff files will need required documents upon reinspection. Corrective action date is May 5th, 2025

Each personnel record must have a completed CF-FSP Form 5131, Background Screening and Personnel File Requirements, which is incorporated by reference in paragraph 65C-22.001(7)(b), F.A.C. B. CF Form 1649A, Child Care Attestation of Good Moral Character, which is incorporated by reference in 65C-22.001(7)(a), F.A.C., must be completed for all child care personnel at the time of initial screening or upon change in employers. CF Form 1649A may be obtained from the Departments website at www.myflfamilies.com/childcare. C. A copy of the eligible results, for the Level 2 screening, generated from the Clearinghouse must be on record for each personnel. If awaiting Out-of-State criminal history results, a copy of the DCF email informing of the individuals eligibility for a provisional hire status must be in the personnel file. D. A copy of the DCF letter/email informing of search conducted of the Floridas child abuse and neglect registry must be on record for each personnel screened between July 1st and December 15th of 2016. E. A copy of each request made to out of state child abuse and neglect registries for individuals who lived outside the state of Florida in the preceding five years. F. A copy of each search conducted for out of state sexual offender/predator registries for individuals who lived outside the state of Florida in the preceding five years. G. A copy of all background screening clearance documents for the director and owner must be included in the Departments official licensing file or in accordance with the appropriate local licensing agency requirements. H. A copy of the Juvenile Records Check with FDLE for any household members aged 12 to 17 years, if facility is located in or adjacent to home of the operator. Form 5131 should be completed by the provider upon hire, and document should be maintained in each staff members file
