17-06 · Outdoor Play Area/Fencing
Licensing Specialist observed the front gate of the fence of the center to have more than a 3.5 inch gap. The latch was not placed on the door and it was easily opened. The gap was covered by a small chair in front. Licensing specialist let provider know that it needs to be a secure gate/fence entrance since the gap or unlatched fence could allow children to exit outdoor play area. Technical Assistance was provided F. The outdoor play area must have adequate fencing or walls a minimum of 4 feet in height. Fencing, including gates, must be continuous and must not have gaps or opening larger than 3 inches that would allow children to exit the outdoor play area. The base of the fence must remain at ground level and be free from erosion or buildup to prevent inside and outside access by children or animals. These areas must have at least two exits, with at least one being remote from the buildings. If an outdoor play area was approved for usage by the Department prior to October 25, 2017, no new exits are required to be added to meet this standard. However, if outdoor play area fencing is changed then the standard would apply, and two exits must be provided

32-03 · Outdoor Equipment
Technical Assistance was provided. 3.12 Outdoor Equipment B. All playground equipment must be securely anchored, unless portable or stationary by design, in good repair, maintained in safe and sanitary condition, and placed to ensure safe use by the children. Maintenance must include inspections conducted every month of all supports above and below the ground and of all connectors and moving parts. Documentation of maintenance inspections must be maintained for 12 months. C. All equipment, fences, and objects on the facilitys premises shall be free from sharp, broken and jagged edges, and properly placed to prevent overcrowding or safety hazards in any one area. F. All equipment used in the outdoor play area must be constructed and maintained according to manufacturers recommendations and allow for water drainage. Any open containers with water must be emptied immediately after use, i.e. pots, toys, or other equipment that collects water

Counselor observed the following ratio: Twos: 7 children to 1 staff Infants: 2 children to 1 staff Mixed (threes and fours): 14 children to 1 staff Additional staff present Counselor observed the two-year-old teacher with 7 two-year-olds and 1 one year old during ratio walkthrough of the facility. Director arrived and moved the one-year-old into the infant room. The move of the one-year-old brought this standard into compliance. The Florida Statues states the following: 402.305 Licensing standards; child care facilities. (4) STAFF-TO-CHILDREN RATIO. (a) Minimum standards for the care of children in a licensed child care facility as established by rule of the department must include: 1. For children from birth through 1 year of age, there must be one child care personnel for every four children. 2. For children 1 year of age or older, but under 2 years of age, there must be one child care personnel for every six children. 3. For children 2 years of age or older, but under 3 years of age, there must be one child care personnel for every 11 children. 4. For children 3 years of age or older, but under 4 years of age, there must be one child care personnel for every 15 children. 5. For children 4 years of age or older, but under 5 years of age, there must be one child care personnel for every 20 children. 6. For children 5 years of age or older, there must be one child care personnel for every 25 children. 7. When children 2 years of age and older are in care, the staff-to-children ratio shall be based on the age group with the largest number of children within the group. Counselor observed 11 children in the two year old classroom. Present were 7 two year old children and 4 one year old children to one staff. Counselor observed another staff member separate the one years children to another classroom. Ratio was brought into compliance at time of inspection. 2.3 Ratios The staff-to-child ratio, as established in Section 402.305(4), F.S., is based on primary responsibility for the direct supervision of children and applies at all times while children are in care. 2.3.1 Mixed Age Groups A. Counselor observed the children's mats torn. The torn mats were thrown away and replaced with non torn mats. This was completed at the time of inspection. 3.6.1 Bedding and Linens C. Nap bedding includes sleep bedding, cots, playpens, play yards or floor mats. Air and foam mattresses are prohibited. D. Floor mats must be at least one-inch thick and covered with an impermeable surface
