Complaint alleges that the child (MA) who is 5-year-old had his teacher Ms. G sit on him. Child complained of pain in the chest and upper body. The cameras will reflect the child being sat on by the teacher. A complaint inspection was conducted on 12/17/2024 and a statement from the teacher (G. Gutsu) was received. Video footage of date in question (12/12/2024) was reviewed. The child arrived at 11:15AM and left for the day at 5:31PM. The child was observed playing and interacting with other children during the day. At 15:20PM, he was observed being made to sit on a chair (time-out). Time-out ended at 15:30PM. He continued to play with other children and was seen attempting to hit other children either with his hand or with a toy or a string. At 15:37PM, he was placed in time-out again by being made to sit on the chair next to the teacher. Time-out ended at 15:50PM. At 16:06PM, he was observed being pulled out of his chair by the arm causing the chair beside the table to flip over. The teacher walked holding him by the arm around the classroom and appeared to be picking up/cleaning up. At 16:07PM, the children left the class and the teacher Ms. G returned to her class alone. Per the teacher, Ms. Gutsu, she denied sitting on the child. She stated that that never happened. She was asked about the second time he was placed in time-out. He was made to sit next to her, facing her. She stated that he was sitting next to her, but she never put her leg over him or against him to stop him from moving. Teacher stated that MA was placed in time-out because it was like the 15th time he had hit another child. She does not remember why she grabbed him by the arm at 16:06PM. She just remember that he was being mean to the other kids, hitting and cursing at them. This complaint alleging that the teacher sat on the child is deemed unsubstantiated. The teacher was not observed sitting or trying to sit on MA. A non-compliance is being issued for not following the school's discipline policy. The child was placed in time out for at least 10 minutes each time and pulled out if his chair by the arm on last instance
