Complainant alleges that two children were wondering a courtyard unsupervised that was accessible through a broken gate. They were found by the maintenance staff and returned to class. The two children were separated from the group when transitioning to another class. A complaint inspection was conducted on 8/24/2024 and statements from the director (R. Sheridan), teachers(J. Light and Y. Greenstein) and maintenance supervisor(O. Monterosa) were received. Per the director, the teachers are newish and she was in the room assisting when it happened. There were two teachers in the room and herself with 12 children. Ms. J was changing a child's diaper when the group was going to Spanish class. The teacher opened the door to take the group to a different class and didn't see the children walk around her and go to the right. The children were going to Spanish class when it happened and Spanish is usually to the right of the classroom but on this day it was held in a different classroom and they had to go to the left after exiting the class. The children were brought back to class by the maintenance manager and brought back to class. Per the teacher (Y. Greenstein), they were going to Spanish class and she didn't see the children walk around her. When they got to Spanish class, she thought the other 2 children were still in the classroom with the second teacher who had stayed behind changing a child's diaper. Per second teacher (J. Light), she didn't see anything because she was changing a diaper when the other teacher and school director were taking the children to Spanish class. She just remembers that Mr. Monterosa came to the room and said that two children were in the courtyard. Ms. Robin was already coming back to the classroom as well to look for the kids so she took them from Mr. Monterosa. Per maintenance supervisor(O. Monterosa), he was cleaning the temple lobby when he saw the children. He stated that they were playing in the courtyard and they were knocking on the lobby doors. He went out to the courtyard and asked "what are you doing here?" he looked around and didn't see an adult with them so he asked "where are your teachers?". Then, he said grabbed them by the hand and walked them back to the preschool side. He doesn't recall who he handed them to but he was just bringing them back and handed them to one of the preschool staff members he saw in the vicinity since they would be more knowledgeable about where they belong. During my walkthrough i observed the gate that separates the preschool from the temple left open but the temple court yard is fenced in. There is a gate that opens out to the parking lot next to the sidewalk that leads to the temple. That gate was left open in that it can be pushed open with ease since the chain that keeps it secure was not locked. I gave recommendation that a better locking mechanism be placed on the gates so that when someone walks in/out they don't remain open. Video footage of incident was reviewed and the following was observed; The teacher (YG) opened the classroom door and held the door open while the children were coming out of the classroom. while she held the door open, two of the first three children that came out walked around her and went to the right side of the hallway and past an open gate. Their shadows are seen going toward the temple. While the classroom was seen walking to the left, a maintenance person was observed walking to the right toward the same director of the temple. The video is fast forwarded and then he is seen walking back to the classroom holding the children by the hand. This complaint is substantiated and a non-compliance and a notice of violation is being issued for a lack of direct supervision. The section number cited in the inspection report is incorrect. The facility is being issued a Notice of Violation for violating Section 7-33(e), Ordinance
