A complaint allegation was received alleging that On 9/6/2024, the teacher, G. Semoy, restrained a child, AH, because she was upset and crying which caused her to hit her head and back on the floor but the child did not sustain any injuries. The duration of the incident was about 16 minutes on and off. The teacher was fired after the incident as this is not the protocol at the Daycare. A complaint inspection was conducted on 9/11/2024 and a statement from the assistant director (Valentina P.) was received. Per the assistant director(VP), the employee was asked to go to VPK to cover a teacher at 3pm. Before going, the 2y/o teacher asked her to cover her classroom while she went to get a child's lunch box in the hallway. When the teacher came back in the room, Ms. Gabrielle Semoy did not leave the classroom. This is when the incident happened. After that happened in the 2y/o classroom, she went to cover the VPK classroom and took the child (AH) with her. In the VPK classroom, she made the child sit next to her for 40 minutes until the parent arrived to pick up. The child started crying when she saw her mom and said pow pow which prompted the mom to ask the school staff to review the cameras and see if anything happened to the child. The school found the footage and showed the mom the next morning. The teacher was terminated that evening. The parent was contacted and video of incident was shown to the parent on Saturday morning. Video footage observed: Gabrielle Semoy was observed looking at the little girl(AH), she walked toward her, then picked her up and took her to the carpet. She pulled a chair and sat in front of the child. Ms. Semoy was observed pulling and grabbing her arms to force her to sit. She picked up her legs and held them together in the air on multiple instances restricting her from moving. The child was attempting to pull out of her grip while the teacher was forcing her to sit on the carpet. The child was observed hitting her head on the floor and her forehead on the chair on two separate instances. This went on from 3:20PM to 3:36PM, a total of 16 minutes. This complaint is Substantiated for not following the school's written discipline policy and using a cruel or harsh discipline method by restricting the child's movements, forcing her to sit and placing her in a strenuous posture for 16 minutes. A discipline non-compliance has been issued

• Allegation: On 8/28/2023 a complaint was received stating that Learning In Motion Preschool released a child to the grandfather without checking his ID. • Findings: • On site investigation to the facility was conducted on 8/29/2023 , an interview with the director A.F occurred and the video footage was observed, indicating that while the grandfather was an authorized pickup person, no staff member asked for his ID at the pick up time. Based on the information gathered this allegation is Substantiated. A Class I Notice of Violation is being issued

A complaint allegation was received alleging that on 04/11/2023 around 5:14pm, The teacher forcibly took the child by the arm, pulled him threw the doorway, she let him go and he fell about 2 feet backwards from the force of being held. The child complained of chest pain yesterday when he was picked up from school. The father noticed that the child had a red mark on his chest while he was in the bath last night. The mark is harder to see today. The video footage was reviewed and showed the teacher on one side of the door and the child is on the other side. The teacher reached around, grabs the child, she yokes him, and then releases him. The teacher was terminated as soon as the facility was notified, A complaint inspection was conducted on 4/17/20223 and the video footage was observed. The staff member (MA) was observed pulling the child by the arm through the doorway to force him to go outside. The child fell back when the teacher let him go. Per director, the staff member was terminated on 4/12/2023 when the video footage of the incident was observed. there is a zero- tolerance policy for this type of situation at the facility. Director checked the child's chest and didn't really see the red mark. No indication on the video footage as to how the child could have gotten the red mark. This complaint is Substantiated and a non-compliance is being issued for not following the school's disciplinary policy. The Director remedied the situation immediately by terminating employment of the staff member in question
