A complaint was received on July 18, 2022, regarding concerns about improper diapering procedures in the two-year-old classroom. At the conclusion of an investigation conducted on July 27, 2022, this complaint is substantiated due to the diapering surface only being disinfected between children. It must be washed with soap and water and then disinfected between each diaper change. There is no requirement that children must be changed away from their peers or that older children can not be changed while standing up.

A total of seven complaints were received from June 14, 2022, until July 7, 2022, regarding concerns about a firearm being present at the facility, improper discipline, lack of respectful communication with children and not following written policies. At the conclusion of an investigation starting June 15, 2022, and ending June 21, 2022, this complaint is substantiated for improper discipline and lack of respectful communication. Staff #1 was seen on video addressing school-age children inappropriately by being highly agitated, yelling, and repeatedly telling them, Keep my name out your mouth, and admitted to also stating, I am not the one. Staff #5 reported that Staff #4 backs children into corners and rips up children s artwork in front of them. During staff members and children s interviews, several incidents reported nearly all staff members had both verbal and physical altercations within the center amongst each other in the presence of children. Staff #2 threatened the owner, fights with other staff, instigates fighting among other staff, had her cousin show up at the center to threaten a staff with a baseball bat, is thought of as scary by a child, uses her phone while working, makes children read as punishment, sleeps during naptime, and yells at children. Staff were barely speaking with each other while working in the center. Additional concerns noted during this investigation include not following screen time limits, two interviewees stating a staff member sleeps while children are in care, the administrator not being present the required number of hours, and the staff handbook not including clear disciplinary policies for staff not following the center s policies. According to the police report received from the New Castle City Police, there was no evidence to substantiate there was a firearm present outside of the center.

A working thermometer is required in refrigerators and freezers. The refrigerator must be 40 degrees or colder, the freezer 0 degrees or colder.
Ensure staff files are completed. Health and Safety for Staff #1,2,3, and 4.
Ensure there is sufficient quantity of equipment. Music is needed in caterpillar and dragonfly rooms.
Ensure children files are completed. Lead screening results for Child # 2,3,5,6, and 7.
Ensure all spaces are in good repair. Replace the ceiling tile in the lobby. Trash Can must be covered in the school-age room.
Children's files need the following: - Child #1 and 7 need updated health appraisals. - Child # 7 needs proof of immunizations and lead screening or affidavit of exemption form notarized.
Send a picture of trash can in the school-age room covered. Re-label the school-age cubbies and send a picture.
Child #10 needs a blood lead screening with their health appraisal.
Indoor space items: - Clean around the light switches and wall in the bathrooms. - Repair/remove broken handle on the kitchen set in the Pre-K room. - Repair the hole on the left side of the school-age room. Repair the corners of the yellow barrier walls in the school-age room. Send pictures when complete.
