Ensure the classrooms are in general working order. The one year old classroom needs a trash can with a lid. The Preschool classroom needs a trash can with a lid on it, the floor to be cleaned daily. Both the one year old classroom and the preschool classroom should discontinue the use of anything that alters the air sell or quality. Each classroom had a can in a chid reach of air freshner available for use.

OCCL received a complaint on August 3, 2022, regarding improper discipline. An investigation was conducted on August 3, 2022. The complaint is substantiated because four children stated a staff member hits the children with her shoe, yells at children, and yanks them up by their arm when they are misbehaving. The children stated another staff also yells at the children. LS McPhatter also observed staff members yelling at the children and one staff picking up a child by his arms to take him to the time-out chair.

On September 20, 2021, OCCL received a complaint regarding the center not notifying parents of an outbreak of Hand, Foot, and Mouth and COVID-19. LS Donovan investigated the complaint via telephone on September 23, 2021. There is no evidence that the center had an outbreak of COVID-19. However, this complaint is substantiated because Ms. Nokes admitted the center had two cases of Hand, Foot, and Mouth and only the parents of the infected children were aware of the disease.

The Office of Child Care Licensing received a complaint on September 1, 2023, regarding improper discipline, not keeping the facility clean, insect infestation, and not having a working refrigerator with the proper temperature. An investigation was conducted on September 9, 2023. There is no evidence to substantiate the complaint for improper discipline because all interviewed staff denied observing any staff hit or push the children. There is no evidence to substantiate the complaint for not keeping the facility clean, having an insect infestation, and not having a working refrigerator because the specialist observed labeled cleaning and disinfecting solutions in the bathrooms, classrooms, and kitchen. The classrooms were clean, the floors were clean, no evidence of insect infestation, and there were no foul odors. The refrigerator and freezer were working and maintain the proper temperature.

On January 23, 2023, the Office of Child Care Licensing received a complaint regarding improper discipline. An investigation was conducted on January 30, 2023. There is no evidence to substantiate this complaint because the owner, administrator, and all staff present were individually interviewed and all stated Ms. Nokes does not yell at the children, no staff member has ever hit a child with a broom, and no staff member has ever sat on a child.

Ensure there is enough staff to run the facility day to day operations such as staff needing breaks for the bathroom or meals, answering the door, keeping the door secured and having someone available to answer it, a staff member available incase parents, guardians, or OCCL come by and need to speak with a teacher or administrator. LS McPhatter entered the facility that was unlocked and no staff available to assist at the front desk or the parent standing waiting in the hallway full access was available to the facility with no staff knowing who would be in the facility. The three staff were in the pre-school room with 17 children ages 1 year to 9 years old. This was corrected at the visit when staff arrived just after 9:00am.

Ensure the facility and equipment is clean. LS McPhatter observed a paper bag full of empty soda and juice containers and a pizza box with some pizza still in it sitting in the hallway. The pre-school classroom has fruit flies in the room swarming near the counter in the back of the room and other places there are food debris. The one year old classroom not in use had four cups with spoiled liquid in them that were attracting insects.

LS McPhatter observed Staff #1 having a difficult time managing the classroom of 20, 3 year old - 9 year old children during a whole class activity. LS McPhatter heard Staff #1 and Staff #2 yell the names of children to get their attention or yell be quiet.

Ensure that each child who sleeps at the center has a safe, clean, age appropriate rest equipment. LS McPhatter observed in the two's classroom two infants asleep one in a swing and the other in a bouncer. The room only had one crib for use. There were four children in the room that had only one cover or blanket during nap time. In the preschool room a ten month old was a sleep on a mat with a bottom and top cover. There were seven children that only had one cover or blanket during nap time.

Ensure supervision and direct observation of children is provided at all times. LS McPhatter observed that staff #1 opened the front door leaving eight children alone in the two-year-old classroom. When LS McPhatter entered the two-year-old classroom alone there were two infants and six other children ages one to two with one qualified staff member asleep. LS McPhatter entered the preschool room and one qualified staff member was there with one ten month old, the other ten children were ages three to 5 years old.

LS McPhatter asked when staff #1 opened the door where the administrator or curriculum coordinator was. Staff #1 replied they were not there. LS McPhatter asked who was in charge Staff#1 couldn't verify and went to get staff #2. Staff#2 was not aware that she was in charge during the absence for the administrator when she stated that she did not know who was in charge. On January 9, 2023, the Office of Child Care Licensing received a complaint regarding diapering, meals and snacks, improper discipline, unqualified staff, sanitation, and health exclusions. An investigation was conducted on January 11, 2023, and January 13, 2023. The complaint is substantiated for improper discipline because the administrator stated she witnessed a staff member raise her voice at a child, who is related to her. The staff member was administratively disciplined for the incident. There is no evidence to substantiate the allegation of diapering procedures not being followed because all staff interviewed stated Child #1 was being potty trained and was changed if wet or soiled. The health checks do not indicate a rash present on Child #1. There is no evidence to substantiate the allegation of not providing required meals and snacks because all staff interviewed stated the facility serves breakfast, lunch, and a snack. All staff stated Child #1 was provided the facility food and food from home but chose not to eat. The specialist also observed all the menu components for breakfast, lunch, and snack for the following day. There is no evidence to substantiate the allegation of unqualified staff because each classroom has an eligible and qualified staff member. The facility also has two eligible and qualified administrators to assist with staffing during the day. There is no evidence to substantiate the allegation of the facility not being sanitary. The specialist observed on two separate visits labeled cleaning and disinfecting solutions in the bathrooms, classrooms, and kitchen. The classrooms were clean, the floors were clean, and there were no foul odors. There is no evidence to substantiate the allegation of not following health exclusions because each staff member stated fevers, vomiting, and loose stool are health exclusions, and children who are sick leave the classroom until they are picked up.
