OCCL s investigation of regulatory non-compliance began after clearance from other agencies was received. On June 23, 2025, an incident was self-reported to the Office of Child Care Licensing (OCCL) by the facility. Also on June 23, 2025, OCCL received a complaint regarding the same incident, alleging rough handling of a child. An investigation was begun on June 23, 2025, and concluded on September 9, 2025, after clearance from other agencies was received. There is no evidence to substantiate this complaint for rough handling of a child. Based on a self-report from Administrator #1, and the review of all documentation received from the child care facility and from three different agencies, Agency Representatives (AR) #1, #2, and #3, Child #1 was not roughly handled by Staff #1. AR #1 found no concern of rough handling in the video footage and the case was reclassified as an injured child with no crime occurring. AR #2 stated with no concern on the video footage, it is possible for positional asphyxia causing petechiae. AR #3 stated they were closing their case as well.

The Office of Child Care Licensing received a complaint on November 20, 2024, regarding unsanitary conditions in the center. An investigation was conducted on November 25, 2024. Based on the results of this investigation there is no evidence to substantiate this complaint for unsanitary conditions. After interviewing the administration and observation of the classrooms, the child care center had no evidence of unsanitary conditions with odors of any kind.

The Office of Child Care Licensing received a complaint on April 26, 2024, regarding children having access to hazardous materials and lack of supervision. An investigation was conducted on May 3, 2024. Based on the results of this investigation this complaint is substantiated for children having access to hazardous materials and lack of supervision in the classroom. On April 25, 2024, Staff #1 brought a vape pen into the classroom where it was in Child #1 s possession for two minutes without the staff member s awareness.

The Office of Child Care Licensing received a complaint on May 2, 2024, regarding allegations of not following diapering requirements, infant feeding requirements, not documenting daily infant care as required, and lack of respectful communication by staff with parents/guardians. An investigation was conducted on May 3, 2024. Based on the results of this investigation there is no evidence to substantiate staff members not following diapering requirements and not documenting daily infant care. Ms. Davis provided copies of a week of infant daily sheets showing diaper changes, topical cream if needed, and notes regarding any soiled clothing. There is no evidence to substantiate infant feeding requirements are not being followed. Ms. Davis provided information and documentation to LS Strachan which was also given to Child #1 s family. This information stated and gave suggestions to Child#1 s family regarding the requirements and helpful hints about infant feeding for different infant ages. Ms. Davis and Staff #1 also had several conversations with Child #1 s family to help them with the changes. There is no evidence to substantiate the lack of respectful communication by staff with parents/guardians. Upon interviewing Ms. Davis and Staff #1, evidence shows they have communicated respectfully and provided detailed information verbally and through documentation.

On December 4, 2023, a complaint was called into the Child Abuse and Neglect Report Line and was accepted for investigation by the Institutional Abuse Unit (IAU). It was sent to the Office of Child Care Licensing (OCCL) on December 5, 2023, and accepted for investigation for lack of supervision. IAU closed their case on January 30, 2024. Law enforcement was involved and OCCL received permission from the New Castle County Police Department (NCCPD) to begin an investigation on January 24, 2024. The investigation was conducted by OCCL on January 31, 2024. On March 7, 2024, OCCL was notified by NCCPD they would be declining prosecution in this case. There is no evidence to substantiate this complaint because based on the NCCPD review of video footage, there was no concerning behavior observed from Staff #1 and IAU closed their case as no evidence to substantiate. Based on documentation received and staff interviews by OCCL, staff members are never left alone if they are not qualified to do so.

The Office of Child Care Licensing received a complaint on February 2, 2024, regarding staff not following correct diapering procedures and lack of supervision on the playground. An investigation was conducted on February 6, 2024. Based on the results of this investigation there is no evidence to substantiate that staff are not following correct diapering procedures because both classroom staff stated they follow proper diapering procedures in the classroom. Also, daily logs from the two-year-old classroom show children s diapers are being checked hourly and being changed as required. There is no evidence to substantiate staff are not supervising the children during outside times because video footage observed showed staff monitoring the outdoor play area and interacting with children.

There is no evidence to substantiate the complaint for improper care of infants because an administrator and specialists scanned through video footage of the infant classroom on March 21, 2023, and did not observe any of the alleged actions occurring. Staff interviewed denied observing any staff moving children harshly or speaking in an inappropriate tone.

On August 30, 2022, OCCL received a complaint for improper discipline. An investigation was conducted on September 1, 2022. This complaint was substantiated because a child was sent to the bathroom when crying to calm down, and video footage showed a child was physically moved to sit on a carpet.
