102417(a) · Operation of a Family Child Care Home. The licensee shall be present in the home and shall ensure that children in care are supervised at all times. This requirement was not me as evidenced by Licensee needs to implement a written Plan of Correction (POC) indicating what steps she is taking to ensure that the day care children are supervised at all times to thus prevent any child(ren) from wandering away from the Family Child Care Home. On January 17, 2023, A 4 year old day-care child wandered away from the family child care home and was found by a passerby. The Licensee will also be required to attend an informal meeting at the San Jose Regional Office within the next 2-3 weeks. A letter confirming the date & time of the conference will be sent to the Licensee via mail. This is an immediate health and saftey violation (zero tolerence) a civil penatly of $500.00 is being accessed today.

102370(d) · CRIMINAL RECORD CLEARANCE All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility Licensee to have Abigail Fernandez and Roberto Lee Buckman fingerprinted with Live Scan by Thursday September 23. Licensee to notify LPA when the they have been fingerprinted.
Licensee's daughter/Assistant Abigail Fernandez does not have criminal record clearance or association to facilty. Robert Lee Buckman was present during inspection and does not have criminal record clearances. Civil penatly of $600.00 is being accessed today Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months.
