    102416.5(b)(3) · (b)For a Small Family Child Care Home, the maximum number of children for whom care may be provided at any one time, including children under age 10 who reside at the licensee's home, shall be one of the following: (3) More than six and up to eight children, without an additional adult attendant, only if the criteria in Section 1597.44 of the Health and Safety Code are met.

    Facility will be provided with the 102416.5 Staffing Ratio and Capacity Regulations for the facility to review and sign. Facility will also submit a written statement explaining how they will prevent another citation regarding being overcapacity. During LPAs visit, Assistant arrived to the facility within 15-Minutes bringing the facility back to compliance. LPA will conduct a follow up inspection with the facility. Based on observation, interview, and record review, the licensee did not comply with the section cited above in where the Licensee was overcapacity upon LPAs arrival to the facility. LPA observed the licensee who was supervising 4 Infants and 4 Preschoolers without an assistant present which poses an immediate health, safety or personal rights risk to persons in care.     102425(a) · 102425(a) There shall be one crib or play yard for each infant who is unable to climb out of the crib or play yard.

    Facility will come up with a written plan by 5/15/2026 and submit to LPA Alvarado by 5/15/2026 in regard to how to ensure that each Infant has their own Crib. LPA will also conduct a follow up inspection to the facility to ensure that the written plan is being followed and each infant in care has their own crib when its time to rest. LPA Alvarado provided a copy of the safe sleep regulation. Based on observation the Licesnee did not comply with this section as, LPA observed two infants placed directly in one Pack N Play.

    Facility will come up with a written plan by 5/15/2026 and submit it to LPA Alvarado by 5/15/2026 in regard to how to ensure that Infant cribs remain free of all loose items and articles. Facility will also submit proof that Licensee and assistants have reviewed Infant Safe sleep Regulations. LPA will also conduct a follow up inspection at the facility to ensure that cribs are being maintained free of loose items. LPA Alvarado provided a copy of the safe sleep regulation. Based on Observation the Licensee did not comply with this section as, LPA observed two infants inside the crib with pillows cushions and nursing Pillows.
