101239(e)(1) · 101239(e)Faucets used by children for personal care shall deliver hot water. (1)Hot water temperature controls shall be maintained to automatically regulate temperature of hot water delivered to plumbing fixtures used by children to attain a hot water temperature of not less than 105 degrees F (40.5 degrees C) and not more than 120 degrees F (48.8 degrees C).
LPA observed staff placing tape over the handles for hot water. Facility had the city maintenance crew arrive quickly, who turned off the water making it inaccessible. LPA was able to confirm during today’s inspection that now the sinks accessible to children do not provide hot water. LPA also provided the facility with the 101239 Fixtures, Furniture, Equipment and Supplies regulations for reference. Based on observation, the facility did not comply with the section cited above, as LPA was able to confirm that multiple sinks that children were using for handwashing had hot water to the touch. Although supervision was being conducted with children washing hands, staff should also be able report when seeing something that could possibly pose a danger to a child in care. The facility has since removed the fixture. LPA observed during the visit that the fixture has been removed. Based upon record review, the facility had one fixture (B) that tested above the Action Level of 5ppb. This posed a potential health, safety, or personal rights risk to persons in care.
