101230(c)(1) · (c) A teacher-child ratio of one teacher supervising 24 napping children is permitted provided that the remaining teachers necessary to meet the overall ratio specified in Section 101216.3(a) are immediately available at the center. (1) An aide who is 18 years of age or older, and who meets the requirements of Sections 101216 and 101216.2, may supervise 24 napping children in place of a teacher if the conditions specified in (c) above are met. This was was not met as evidenced Director stated that she will provide a plan of correction on how she will ensure that ratio is being met during nap time, ensuring an aide is not left alone when children are not sleeping during nap time. The plan should include the process to bring in a teacher when napping conditions are not being met. Plan will be sent to jennifer.patel@dss.ca.gov. Based on LPA observations, facility was out of ratio as 4 of 13 children were awake while napping and being supervised by an aide and no teacher which poses a potential risk to the health, safety, and personal rights of persons in care. Director stated she is now aware of the regulations and procedures when there is an incident that occurs and will make sure to report all incidents moving forward. Based on record review and interview D1 was aware of an incident that occurred on 12/09/2024 and did not report the incident to the Department within the Department’s next working day during normal business hours. This poses a potential health, safety or personal rights risk to persons in care.
