  102423(a)(2) · (a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee ... (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. This requirment is not met as evidenced by Licensee agreed to submit a written plan of correction on how to ensure that swing will not be used as a napping equipment for infants. Child # 1 was observed to be napping in a swing, Licensee stated C1 just fell asleep and was about to be transferred to a pack and play. However, Staff 1 and Staff 2 corroborated and a video posted on the social media showed C1 was napping on the swing. This posses an immediate risk to health and safety of children in care.
