101223(a)(3) · Personal Rights - (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.
Site Director stated that she will submit a written plan to Licensing by 07/03/25 to ensure that children's personal rights are not violated. Site Director stated that an All Staff Meeting will be conducted on 07/11/25 and children's personal rights will be included. Meeting agenda and attendance sheet to be sent to Licensing by 07/14/25. On 06/27/25, Staff (S1) violated children's personal rights by grabbing a child (C1) on the waist and sat the child down on the chair, pinching a child (C2) on the arm using a pair of tongs, and withholding food to a child (C1). This posed an immediate risk to the health, safety, and personal rights to children in care.
