(1)No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. Site Director states that she will submit a written plan by 10/16/25 to ensure that there is always a qualified teacher in the classroom. Site Director states that a staff training regarding supervision will be conducted and will submit training agenda as well as proof of attendance by 10/20/25.

Based on LPA's observation and record review, a teacher's aide (S1) alone in Room 10 supervising 10 children. This posed an immediate risk to the health, safety, and personal rights to persons in care Because the facility repeated the same violation within 12 months, an immediate civil penalty of $1,000 is hereby assessed. An ongoing civil penalty of $100 per day will be assessed until the violation is corrected.

Site Director states that she will submit a written plan by 10/16/25 to maintain the required ratio and capacity at all times. LPA observed a teacher (S3) alone in the Room 9 supervising 13 children. This posed an immediate risk to the health, safety, and personal rights of children in care. 101239(a)(1) · Fixtures, Furniture, Equipment and Supplies - A comfortable temperature for children shall be maintained at all times.(1) The licensee shall maintain the temperature in rooms that children occupy between a minimum of 68 degrees F (20 degrees C) and a maximum of 85 degrees F (30 degrees C). Site Director states that she will submit a written plan by 02/27/23 detailing how the facility will maintain comfortable temperature in the classrooms at all times.

LPA learned from interviews that the temperature in few of the preschool classrooms were below 68 degrees Fahrenheit during the power outage that occurred on 02/21/23 to 02/22/23.

101216.3(b)(1) · Teacher-Child Ratio - The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. (1) A ratio of one fully qualified teacher (as specified in Section 101216.1(c)) and one aide for every 18 children in attendance in a preschool program is allowed when the aide meets the qualifications specified in Section 101216.2(d). Site Director submitted proof that the teacher's aide is currently enrolled in early childhood education (4 quarter units) was submitted to Licensing. Deficiency corrected.

LPA learned from interviews that on 11/22/21 a fully qualified preschool teacher and a teacher's aide who completed more than 6 semester or equivalent quarter units in early childhood education were supervising 21 children in the playground.
