    102416.5(e) · 102416.5 Staffing Ratio and Capacity (e) (e) If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c).

    The licensee must review the Staffing Ratio and Capacity regulations and operate strictly within the licensed capacity at all times. When no assistant is present, the licensee must operate at a small license capacity and limitations. The licensee will maintain an accurate headcount throughout the day and will not accept additional children beyond the allowable capacity unless a qualified assistant is physically present. Based on observations and interviews, the licensee did not comply with the section cited above. The licensee was operating over the allowed capacity when no assistant was present. At the time of inspection, the licensee was supervising eight children (three infants and five preschool-age children), exceeding the maximum capacity permitted for a large family child care home without an assistant. This posed a potential health and safety risk to children in care. The licensee will review and follow the capacity requirements outlined in CCR 102416.5 and submit a written statement to the Department by April 24, 2026, confirming understanding and compliance with staffing ratio and capacity regulations.
