101175(b)(1) · 101175 Waivers and Exceptions for Program Flexibility (b) The Department has the authority to approve the use of alternate concepts, programs, services, procedures, techniques, equipment, space, personnel qualifications or staffing ratios, or the conduct of experimental or demonstration projects, under the following circumstances: (1) Such alternatives shall be carried out with provisions for safe and adequate services, and shall in no instance be detrimental to the health and safety of any child in care. The facility must adhere to her outdoor waiver limitations and requirements. The facility owner states she will reduce the number of children outdoor and provide Licensing with a written plan/schedule to comply with the outdoor facility waiver by August 1, 2022. A written plan and schedule will be sent to LPAs.
Based on observation and interview, the facility did not comply with the Departmental-issued outdoor waiver, a ratio of one teacher to two children in a public park. LPAs observed 21 children and only 6 teachers. The facility did not adhere to the waiver, which poses potential health, safety, or personal rights risk to children in care

101170(e)(2) · 101170 Criminal Record Clearance (e)All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility:(2) Request a transfer of a criminal record clearance as specified in Section 101170(f) or Licensee shall submit a written Plan of Correction (POC), ensuring new employees submit a request for the Live Scan application or transfer request. Written POC shall also describe how the Licensee shall prevent future recurrences of this deficiency. (During the inspection, the owner accessed Guardian and associated all four staff to her facility. This deficiency is considered corrected and cleared as of today.) This evidence is not met, as evidenced by records review, Licensee failed to ensure all employees had a criminal record clearance associated to the facility prior to employment, posing an immediate health and safety risk to children in care.
