101238.2(d)(2) · OUTDOOR ACTIVITY SPACE. The surface of the outdoor activity space shall be maintained:... Free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard. This requirement has not been met as evidenced by UTK Teacher who was present, trimmed plants on site while LPA's were inspecting the playground. Mr. Rios stated that they will ensure that the plant stays trimmed and that the playground is inspected for hazards before children are present. Mr Rios states that appropiate supervision will be in place.
Based on observation, facility did not comply with regulation in that there was a potted artichoke plant with small spikes accessible to children on the playground. This is a potential risk to the health and safety of children in care Mr Rios states he will communicate this information to Lead Teacher, Principal, and other staff.

… Both staff members were spoken to and staff have been advised to put any confrontational situations in writing and Principal is copied on it. Corrective measures have been taken to ensure it doesn't happen again. Based upon staff interviews, a verbal altercation occurred between staff members in front of parents and daycare children on 4/29/24 which is a potential health, safety and personal rights risk to children in care. Director also stated that the AM and PM programs going forward will have uniform procedures (gatekeeper procedure) to aid with communication between teachers and resolve conflicts. Principal stated she would send new procedures to LPA Lane via email by 5/9/24.

… Principal stated she met with S1 and discussed personal rights of the child and held a meeting with parents and both teachers in the classroom regarding the incident. Principal also held individual trainings with staff members about how to report concerning incidents immediately and procedures to follow. Principal stated she would send documentation of the trainings with staff signature by 5/9/24 to LPA Lane via e-mail. Based upon numerous staff interviews and unusual incident reported to the Department from the facility, staff member (S1) restrained a child (C1) during lunch for over 20 minutes while the child was visibly upset which is an immediate health, safety and personal rights risk to children in care.
