101229(a)(1) · 101229(a)(1) Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. Director will conduct a meeting with staff members of room PS2(preschool room #2) regarding student count protocols. Director will formulate and implement additional student count protocols to ensure no child is left unsupervised. Director will provide a copy of the updated protocols signed by all PS2 staff. POC cleared during visit.
Based on interviews and video footage obtained the facility did not comply with regulation above wherein one daycare chid was left unsupervised for approximately 5 minutes. Mrs. Lambert stated that she will designate Maribel Marquez (fully qualified teacher) to work in the PS2 room with another fully qualified teacher plus 2 aides effective 8/19/24. Based on interviews conducted with staff, facility was out of ratio with one fully qualified teacher and 2 aides with up to 24 children.

Mrs. Lambert stated that she will conduct an all staff meeting with her teachers today at noon to discuss children's personal rights. She will submit topics covered during the meeting and copy of staff sign in sheet. Based on statement from a witness and recorded videos, a staff was observed swatting a child on the buttocks, swatting a child on the hand, hitting a child on the shoulder, yanked a child by the hair and forcibly sitting a child on the carpet.
