101212(d)(1)(C) · 101212 Reporting Requirements (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. Director stated she would report the unexplained injury that occurred to child C1 by 11/8/24 and e-mail the LIC624 Unusual incident report to: SDIncidentreports@dss.ca.gov Based upon Director interview, an incident report was not provided to Licensing regarding an unexplained injury that occurred to a child in care. The facility became aware of the unexplained injury when a parent reported it to a staff member, but did not report it to the licensing department which is a potential health, safety and personal rights risk to children in care. 101229(a) · THIS IS AN AMENDED REPORT CCR 101229(a) Responsibility for Providing Care and Supervision: (a) The licensee shall provide care and supervision as necessary to meet the children's needs.
The Director stated she had 1:1 meeting with staff members. They now have more staff on the playground and make sure that staff is supervising under the play structure. They have also received training on how to talk to children about respecting their bodies. The Director will hold a staff training meeting where staff will view supervision videos and Director will send LPA a copy of the agenda and attendance sheet via email Annette.Sutherland@dss.ca.gov by 6/30/24. Based on interviews with staff and parents and review of documentation, visual supervision was not sufficiently maintained to prevent inappropriate interaction between children on the playground. This poses an immediate risk to the health and safety of children in care.

Director has provided correction on today's visit. She will ensure that in the future incidents are reported on the duty line (619)767-2248 and submit an incident report by email to SDIncidentReports@dss.ca.gov or by Fax at (619 767-2203 within 24 hours by phone and 7 days by mail/email of occurring. Licensee will also provide written statement explaining that she will submit future reports per the required time frames. Deficient Practice Statement Based on observation during the facility tour, the licensee did not comply with the section cited above in that four rooms had items that state "keep out of reach of children" in areas that are accessible to children. In each case, the item was either under a sink or in the back corner of a counter near a teacher which posed a potential rather than immediate health, safety or personal rights risk to children in care.
