  Licensee has obtained a helper and transferred their clearance to the license on 08/12/24. Licensee said he will not care for more than 8 children without a fully qualified helper. LPA gave Licensee with a copy of CCR 102416.5 and the ratio/capacity worksheet. Licensee & LPA reviewed these documents together. The The facility is licensed for 14 children and has no assistant. In July 2024, the Licensee cared for more than 8 children without an assistant. Based on interviews and record reviewed the Licensee did not ensure the daycare’s legal ratio, which poses as an immediate risk to children in care. Licensee said he will give LPA with a written statement acknowledging an understanding of this code section and legal ratio. Licensee said he will give LPA a written statement on how they will only care for no more than eight (8) children without a fully qualified helper.
