101223(a)(3) · 101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.
Staff (S-2) has been terminated. Director shall submit a written plan by 07/16/25 detailing the steps the facility has taken to ensure that children's personal rights are not violated. Based on interviews conducted and including video footage on 07/02/2025 staff (S-2) sprayed child (C-1) inappropriately with hose to calm child down. Video footage showed staff (S-2) directly spraying the hose on child (C-1) face. This poses a potential risk to the health, safety, and personal rights to children in care. Director shall also provide training for the staff regarding appropriate discipline to use. Director shall forward a copy of the training agenda and meeting minutes to LPA by 07/16/2025. Licensee will submit a written plan of action by POC due date 08/11/23 indicating plans of remediation (i.e plumbing/repair of outlet) for the identified lead exceedance on main water valve exterior Based on observation and record review, Licensee did not comply with section cited above. Lead Sampling Report on 11/3/22 indicated that water from outlet “S” located in Wonderer's Room has elevated lead above 5.5 ppb. Water sampling on 12/19/22 indicated lead exceedance above 5.5ppb on facility’s main water valve exterior A and A30 which pose a potential risk to the health, safety, or personal rights of children in care.
