On 8/21/2024 a child (C-1) uses a toddler chair to jumped over the fence staff (S-1) was not aware until another child (C-2) informed staff (S-1) child (C-1) had jumped over fence. A good samaritan walking in the sidewalk found child (C-1) and redirected to staff (S-1) in the outdoor play area. This poses an immediate threat to the health and safety of children in care According to AB 633, parents must be provided with this report which contains this Type A deficiency for the next 12 months and copy of signed acknowledgement form must be kept in each child's file. Deficient Practice Statement Based on observation, the licensee did not comply with the section cited above during indoor and outdoor inspection LPA observed a exit door that leads to playground to have a broken door nob hard to close, a crack toy chair, rusted/broken seesaw, rip children sofa, and outside area has a tree near picnic tables that has roots sticking out of ground and is a tripping hazard in which poses/posed a potential health, safety or personal rights risk to persons in care. 101223(a)(3) · 101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.
Director will submit a written plan on how yelling to children will be prevented and provide training to staff in regards to the personal rights of children. An agenda and an attendance sheet of all staff that attended will be submitted to Community Care Licensing by POC date of 07/22/2022. Based on interviews, staff yell at children in care using intimidating tone. This poses an immediately risk to the health and safety of children in care. AB633 Parent Notification is required. According to AB 633, all parents of children currently enrolled and any future children being enrolled for the next 12 months must be provided with this report which contains this type A deficiency.
