102423(a)(4) · (a) Each child...shall have certain rights that shall not be waived or abridged ...These rights include, but are not limited to, the following:(4) To be free from…actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning. Licensee will provide a written acknowledgment of the regulation and a statement confirming that they will remain in compliance. The statement can be provided to LPA Gallo by email at matthew.gallo@dss.ca.gov by the POC due date.

Based on interview, the licensee did not comply with the section above by taking a child's lunchbox containing snacks away as a form of discipline. This poses an immediate health, safety, or personal rights risk to persons in care

Safety precautions shall include but not limited to: (4) Poisons, detergents, cleaning compounds, medicines, firearms and other items which could pose a danger if readily available to children shall be stored where they are inaccessible to children. (A) Storage areas for poisons, firearms and other dangerous weapons shall be locked.

Deficient Practice Statement Based on observation and interview, the licensee did not comply with the section cited above by storing poison plant killer in latched kitchen sink, but it was not behind a lock as per regulations which poses an immediate health, safety or personal rights risk to persons in care. 102417(g)(9)(A) · Operation of A Family Child Care Home (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (9) Each family child care home shall have a written disaster plan of action prepared on a form approved by the Department. All children, age and ability permitting, and the provider, the assistant provider, and other members of the household, shall be instructed in their duties under the disaster plan. As their age and ability permit, newly enrolled children shall be informed promptly of their duties as required in the plan. (A) Each family child care home shall conduct fire drills and disaster drills at least once every six months.

Deficient Practice Statement Based on observation, interview, and record review, the licensee did not comply with the section cited above by not conducting and documenting a fire drill on a fire drill log in last 6 months which poses/posed a potential health, safety or personal rights risk to persons in care. Deficient Practice Statement LPA observed a grass/weed killer chemical near the side shed and cleaning chemicals such as Comet Bleach in an unlocked cabinet. LPA observed the Licensee immediately correct, and remove, the chemicals upon request. Although immediately removed, these chemicals had been previously accessible to children. This had posed an immediate health and saftey risk to children in care. POC Due Date: 05/16/2023
