    101161(a) · Limitations on Capacity and Ambulatory Status (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation.

    Deficient Practice Statement Based on observation, when LPA Owens arrived at the facility there were 19 preschool children, the Director, her 3 month old baby, two teachers and 8 parent volunteers. The facility is licensed to serve 24 preschool children ages 2.5 years old to entry into kindergarten. The licensee / Director did not comply with the section cited above in that her 3 month old baby was present at the facility, being held by parent volunteer. This poses an immediate health, safety risk to persons in care. A form LIC9224 was given and discussed with Director at time of inspection. Upon receipt of the LIC9224, licensee shall post and provide copies of the licensing report to parent/guardians of children in care and the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months.
