On May 12, 2026, Director Del Calvo notified LPA Yang in writing that the new play structure had been assembled and installed in the primary play yard and requested an inspection and approval before children were permitted to use the equipment. During today’s inspection, the LPA inspected the facility’s newly installed play structure and approved it for use. This deficiency has been cleared. Based on interviews and the LPA’s observations during the complaint investigation, it was corroborated that daycare children were allowed to use a play structure that had been designated off-limits due to safety concerns, and the structure was not made inaccessible to children in care.

Director Del Calvo reported that staff member S1’s employment was terminated immediately upon completion of the facility’s internal investigation. To ensure that similar deficiencies do not recur, the Director will implement mandatory in-service training for all staff. The training will focus on children's personal rights, including but not limited to dignity, respect, and protection from inappropriate conduct. Based on the Center Director’s statements on 4/14/26 and the Unusual Incident Report (UIR) submitted by the facility on 3/19/26, it was determined that staff member S1 violated the personal rights of children C1, C2, and C3 on more than one occasion by denying a child the ability to use the bathroom and by roughly handling two children in care. This posed a potential health and safety risk to persons in care. The training will be conducted by the Director, and all current employees will be required to attend.Documentation of this POC will include a sign-in sheet verifying attendance, with staff names and signatures. Additionally, detailed training materials and an outline of the topics covered will be maintained. These documents will be submitted to LPA as evidence of compliance. Center Director Del Calvo stated that as an interim safety measure, the center will restrict access to the play structure by using tape to seal off the climbing areas/stairs and notifying staff not to use that area. Based on the LPA's observation on 11/14/25 and 11/20/25, the LPA observed observed that the facility’s Little Tikes plastic play structure was not in safe operating condition. The LPA noted that a metal cylindrical pin,approximately four feet in length, which is intended to secure a section of the play structure’s interlocking plastic panels to the frame, had become loose. Additionally, the LPA observed that the plastic pyramid-shaped roof component of the play structure was no longer securely attached to the metal frame. This poses an immediate health, safety and/or personal rights risk(s) to children in care. The Director stated she will work with the District Manager to take action on replacing the play structure. The Director shall submit a plan in writing to the LPA by end of day 11/21/25 indicating how the facility and KinderCare plans to bring the play structure back into compliance and shall notify the LPA once work has begun on the play structure. Center Director Del Calvo stated she will work with the District Manager to take action on repairing or replacing the sunken area(s) in the facility's main play yard and submit proof to the LPA by 12/05/25. Based on the LPA's observations on 11/14/25 and 11/20/25, the LPA observed an area of lawn immediately next to the concrete play area/tricycle track that is uneven and sunken compared to the surrounding ground. In some spots, the dirt has sunk approximately eight inches, creating a tripping hazard for children and staff. During the initial investigation visit on June 20, 2025, Former Director Richardson created an isolation area in the main office for sick children awaiting pick up by their authorized representative. The facility's current director, Nicole Del Calvo stated that she will submit to the LPA an updated facility illness policy outlining its policies and procedures for dealing with sick children at the center. Based on interviews conducted with facility staff S1 through S15 during the investigation, it was corroborated that on numerous occasions, sick children remained in their classrooms with symptoms such as fever, diarrhea, vomiting, or signs of hand, foot, and mouth disease including mouth sores and rashes on the hands and feet while awaiting pick up. Former Director Richardson admitted that the facility did not have an isolation area set up for sick children. This poses a potential risk to the children in care.

Director Nicole Del Calvo stated that she will provide training to all preschool staff members regarding injury reporting procedures, follow-up actions, and incident/injury report writing. Based on the interviews conducted by the LPA and former center director, Kylie Richardson’s own admission on June 20, 2025, it was corroborated that the facility did not notify child C1's authorized representative of their concerns regarding a suspected head injury in a timely manner. It was corroborated through interviews that child C1 was struck on the back of the head by another child with a metal water bottle, resulting in a bump. It was further corroborated through interviews that C1’s authorized representative was not notified until pick up time that day. The center director, Alexandria Pepper stated that on 10/09/23 all staff watched the Children's Personal Rights in Care video on the ccld.ca.gov website and reviewed and discussed the written regulation cited above during their all staff meeting on 10/09/23. A sign in sheet with staff names and signatures to verify training was submitted to the LPA via email on 10/09/23. Specifically, it was corroborated through interviews that S5 and S8 have made inappropriate statements to children regarding their appearance and/or personal hygiene. LPA observed that the facility has temporarily removed the affected faucets “A”, "F", and "M" from service by way of a plastic cover. The facility plans to replace the faucets and will retest and submit test results to LPA at yang.yang@dss.ca.gov by 03/01/23. Based on a record review, the facility had three faucets (Site “A”, "F", and "M") that exceeded the allowable levels of lead in the water. They had a reading of 19.0ppb, 13.0ppb, and 6.0ppb, respectively. This is a potential health and safety risk to children in care. based on the LPA's observations on 07/21/21 at 11:29am and information obtained from staff interviews, the center did not repair a cracked window and water damaged and moldy ceiling tiles in the "pre-k" room in a timely manner. In addition, the center did not take appropriate measures to keep the center free of wasps, which resulted in numerous children being stung while on the play yard. Lastly, the center did not ensure that all power receptacles at the facility are in good repair. Staff interviews revealed that a power receptacle located in an accessible area of the play yard had exposed electrical wiring This poses a potential health and safety risk to the children in care. The facility has replaced the two damaged ceiling tiles, repaired the cracked window in the "pre-k" classroom, and has repaired the damaged power receptacle in the play yard using a blank wall plate.
