101216.3(a) · Teacher-Child Ratio 101216.3(a)- There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below.

Facility will submit written plan of coverage to accomodate teacher-child ratios for the preschool and toddler option programs by POC due date to the department. Based on interviews conducted, records reviewed and LPA direct observation- the facility did not maintain teacher-child ratios for preschool with toddler option component. This is a potential health and safety risk to persons in care.

101161(a) · 101161(a) Limitations on Capacity- (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation.

Facility will cease co-mingling of toddlers/preschool with school age children by POC due date. Based on interviews conducted, records reviewed and LPA direct observation- the facility allows commingling at the beginning and end of each day. This is a potential health and safety risk to persons in care.

101238(a) · Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.

Deficient Practice Statement Based on observation, the licensee did not comply with the section cited above in that LPAs observed during tour access to electrical equipment, cleaners, sharps, poisons, and partially blocked hallway, which poses/posed a potential health, safety or personal rights risk to persons in care. 101238.2(d)(2) · Outdoor Activity Space (d) The surface of the outdoor activity space shall be maintained: (2) Free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard.

Deficient Practice Statement Based on observation the licensee did not comply with the section cited above in that LPAs observed torn hard rubber with sharp edges on play structure, which poses/posed a potential health, safety or personal rights risk to persons in care. POC Due Date: 02/17/2025

101223(a)(3) · Personal Rights The licensee shall ensure that each child is accorded the following personal rights: To be free from...infliction of pain, humiliation, intimidation, ridicule...not limited to: interference with functions of daily living...

(1) The director will contact Resource & Referral (R&R) to obtain resources on working with children with challenging behaviors. (2) The director will conduct an in-service with staff presenting using the information obtained by R&R. All staff members will sign a rooster; the rooster and itinerary will be sent to the LPA by POC date. C1 had 18 behavioral incidents violating the rights of the other children and staff at the facility. The facility failed to enact any disciplinary actions as stated in the facility policy which poses an immediate health, safety or personal rights risk to persons in care. Training must be completed within 30 days of the POC date.

101219(f) · Admission Agreements: The licensee shall comply with all terms and conditions set forth in the admission agreement.

The director/licensee will update the terms and conditions of the admissions policy/procedures. The licensee and the director will submit a memo of understanding ensuring they will abide by the submitted policies. Both will be submitted to the LPA by POC date. The facility failed to enact the terms of their admissions agreement by allowing C1 to remain in care at the facility which poses a potential health, safety or personal rights risk to persons in care. 101516.5(b)(1) · 101516.5 Teacher-Child Ratio(b) There shall be a staffing ratio of one teacher and one aide present to every 28 children in attendance.(1) A teacher shall supervise no more than 14 children or with an aide a maximum of 28 children.

Immediately, Director agrees to maintain teacher-child ratios. Director agrees to submit a written statement addressing how ratios will be maintained and will submit a copy to LPA by 11/1/21. Based on observation, the Director did not ensure all there were appropriate ratios being met as one staff was supervising 22 children, which poses an immediate Health, Safety, or Personal Rights risk to persons in care.

101238.2(a) · 101238.2 Outdoor Activity Space (a) There shall be at least 75 square feet per child of outdoor activity space based on the total licensed capacity.

Immediatly, Director agrees to submit an updated schedule and post it each classroom. Director agrees to submit updated schedule to LPA by 11/1/21. Based on observation, the Director did not ensure children were not commingling as it was observed Preschool and School-age children were both on the play ground, which poses an immediate Health, Safety, or Personal Rights risk to persons in care.
