102370(d)(1) · (d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department.

Immediately, licensee agrees to ensure all individuals obtain a criminal record clearance prior to working in the home. Licensee agrees not to have A1 return until they have a clearance. Licensee agrees to submit a written statement of their understanding of the regulation and their statement acknowledging A1 will not return until they have a criminal record clearance by 12/18/25. Based on licensees’ own admission and interviews, an uncleared adult (A1) was left to supervise daycare children, which poses a potential/immediate health, safety or personal rights risk to persons in care. Licensee had A1 get their livescan on 12/10/25, however, a clearance has not been obtained.
