Facility agrees to submit a statement of understanding on the importance of obtaining written consent from parents/authorized representatives in the event that they change their mind and request photos for their children in care. The course of the investigation revealed that the facility posted pictures of the subject child on social media channels, when they did not have written consent, according to the signed admission agreement. The facility stated that they did recieve a verbal request for photos on the TLE app. Facility also agrees to provide all parents/authorized representatives who have requested photos verbally, with a updated permission form that grants the facility photo consent in writing. On or about 01/10/23 and 03/01/23, subject staff admitted to “accidentally” pinching children in care during redirection. Multiple children disclosed being pinched by the .... subject staff on different occasions which poses an immediate risk to the health, safety, and well-being of children in care.

Immediately, director agrees to ensure proper supervision is maintained for children in care by providing staff support. Director also agrees to conduct an in-service training surrounding supervision and send proof of training agenda and staff attendance to licensing by 08/06/2022 or next business day. On 05/02/22 a child was bitten. Although a report was on file, the investigation revealed the biting incident was not visually observed by staff. On 05/10/22 during a tour of Twaddler A's classroom. During census, LPAs noted that one child was hiding behind the diaper changing station unknown to staff. This poses an immediate Health and Safety Risk to children in care.

Director submitted form LIC9182, LIC508, and copy of photo ID via Guardian during today's visit. S1 is now associated to the facility. Deficiency cleared. Based on review of records, it was found that a staff member was supervising children in care with no criminal record fingerprint association to the facility. Staff has an active-working fingerprint clearance, however facility failed to submit a Criminal Background Clearance Transfer Request (LIC9182) to the department.
