102417(5) · a (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A) Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The licensee added a door alarm to the sliding glass door and a stick in the door track. The licensee moved the play structure that was located next to the fence. The licensee stated she will add fencing to the existing fencing so that the pool is made inaccessible by a five foot fence. Based on the licensee's statement and LPA's observation, a portion (approximately 20 feet) of the pool fencing is not five feet high This was an immediate health and safety risk to children in care.
