101416.2(f) · 101416.2 Infant Care Teacher Qualifications and Duties (f) Teachers shall visually observe aides whenever aides are working with infants, except as provided for in Section 101416.5(d)(1).
Director stated Fully Qualified Infant teacher shall visually observe aides and Director stated she will make a teacher qualifications chart for the staff to review. Director will provide the chart to LPA by email no later than 4:30PM POC due date. On 03/20/24 LPA visit, it was determined by observation, record review, and interviews that 2 out of 3 staff were aides and 1 fully qualified infant teacher. LPA observed both aides were left inside the facility with 7 awake infants and engaged in activities, and the fully qualified infant teacher was in the playground with 4 infants and did not have visual observation on the aides.

Director stated that disinfectants and hazards were moved and stored in the staff bathroom, inaccessible to children. Cleared at time of visit. LPA interviews and documentation revealed that hazards accessible to children when disinfecting wipes are left on the table where the infants eat, and are stored where it is accessible to children.

Director stated they will follow Staff-Infant ratio and inform staff not accept another child until another staff is available to step in. Director will email LPA by 4PM POC due date the facility's written plan of action with staff signatures. LPA arrived at facility at 7:55 AM and observed census of 7 infants and 2 staff; at 8:00 AM, 8th infant was in attendance, and at 8:12 AM, 9th infant was accepted. Staff messaged the other facility for help, but no one was available to step in until LPA observed Director walked in at the facility at 8:17 AM which poses an immediate health, safety, or personal rights risk to persons in care.
