This deficiency was corrected today. Form LIC 9182 was immediately sent to the department via email. Based on record review, the licensee did not comply with the section cited above. Substitute Nijmeh Erras’s fingerprint clearance is not associated to the facility. This poses a potential health, safety or personal rights risk to persons in care. SUPERVISOR'S NAME: Joelle Redding

101161(a) · 101161(a): A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation.

Director stated due to confusion between Title 5 and 22 regulations the Director believed he was allowed to commingle first and last hour of operations since Title 5 allows it. Since understanding the difference, Director stated until they are fully licensed as a Title 5 facility, they will operate under Title 22 regulations. Deficiency cleared during visit. Based on investigation interviews with parents and staff, the center commingled infant children with preschool children on a minimum of 2 occasions and a school ager with preschool child on one occasion.

101238.2(d)(2) · Outdoor Activity Space- (d)The surface of the outdoor activity space shall be maintained: (2)Free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard.

The Director fenced off the storm drain area on 1/3/24 and made the Upper Pre-K outdoor play area free of hazards for children in care by making it inaccessible to children and submitted proof to the dept. on 1/24/24. Based on observation and interviews there was an accessible storm drain at the top of a slope on the playground, approximately 2 ft. deep that created a potential safety hazard to children in care playing around that area. This posed a potential risk to the health and safety of children in care.
