Per LPAs observations and Staff own admission facility has been out of ratio approximately 3-5 times during 03/23 and 04/2023. In addition, Director agrees to provide a plan of action for back up personnel to anticipate teacher absences due to unforeseen situations to be in substantial compliance. Statement of understanding will be providing by morning staff to be in substantial compliance according to Title 22/101216.3(a) Teacher to Child Ratio. Upon arrival to the facility LPA Ruiz observed 15 children in the multipurpose room (Classroom N.61) under the supervision of Staff N.1. Few minutes later Staff N.2 arrived to remove additional children and they were taken to Classroom N.93 with Staff N.3. "This is an immediate Health and Safety risk for the children".

CCL was notified 8/26/2022 and director discussed issue with staff 8/29/2022. Director stated he will conduct a staff meeting on 10/6/22 on personal rights, and safety of children and will send the topics and a list of participants to CCL by 10/7/22. Based on interviews with staff a child was being held due to their refusal for going inside and is considered a form of restraint This is an immediate risk to the health, safety and personal rights of children in care POC discussed with director.
