  101223(a)(3) · 101223 Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights... not limited to... toileting; or withholding of shelter, clothing, medication or aids to physical functioning.

  The facility is required to ensure that all teachers are aware and have training, or refresher training, on the personal rights of children as stated in Title 22, section 101223, of the regulations. The facility will conduct training on this matter and submit all training materials and evidence of teachers' participation to LPA Tran by January 30, 2026. Based on interview and record review, the facility did not comply with the section cited above when a staff member stopped a child from going to the restroom, which posed a potential health, safety or personal rights risk to persons in care.
