After the incident, the licensee took appropriate action by denying the assistant any future access to the facility. As of today, 10/1/2025, the deficiency has been cleared. Based on record review and interview, the facility did not comply with the section cited above due to a now-dismissed assistant correcting behavior by yelling at a child in a tone and volume that abridged the child's personal rights. This posed an immediate health, safety, or personal rights risk to persons in care.
