101229(a)(1) · 101229 Responsibility for Providing Care and Supervision: (a)(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. Facility agrees to create a written plan/policy on how staff will assure the required Care and Supervision to children while children are being dismissed. Facility has already implemented new dismissal procedures and these new procedures will be included in this plan. This was not being met as evidenced by video footage showing staff not having visual observation of Child 1 (C1) as C1 exited the exterior gate of the facility, then walked back and entered back through the exterior gate. This poses an immediate health, safety or personal rights risk to children in care. The above mentioned written policy will be submitted to the Department by the POC due date.
