101161(a) · Limitations on Capacity 101161(a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. LPA Estoesta advised the licensee /director to develop a plan of correction (POC) and the POC submit proof to the Oakland Child Care Regional Office via mail only on or before the POC due date. LPA and the Director discussed the POC, that it shall describe how it will bring their facility into compliance, and it must be measurable and verifiable. It included, but not limited to, updating and maintaning records, staff training and meetings, and family engagement documentation.

, Based on the reviewed records that Child 1, 2 and 3 (C1, C2 and C3) were admitted and enrolled before C1, C2 and C3 turned 18 months old. The facility is licensed to serve preschool children (ages 2 years to 6 years old), and 18 months and 36 months of age in the toddler program. This poses a potential risk to health, safety or personal rights to children in care. The licensee will submit a written statement that the licensee understands the licensed child care age limits, capacities, and staff ratios are strictly regulated by department, and that to review the full Title 22 compliance guidelines on the section cited. The written statement will be mailed to the child care regional office. LPA recommended to the Director that the licensee can register to the CCLD's Technical Support Program (TSP) which is FREE, voluntary, and a non-enforcement service of Community CareLicensing to assist childcare providers experiencing compliance challenges. LPA also provided a copy of the CHILD CARE ADVOCATE PROGRAM flyer to the director.
