Operation of a Family Child Care Home 102417(g)(5)(A) (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate... Deficient Practice Statement Based on observation, the licensee did not comply with the section cited above in that LPA observed a cement ledge located by the back fence of the backyard adjacent to the pool fence. LPA measured the cement ledge to the fence, and it did not meet the requirements as per Title 22 regulations, which poses/posed a potential health, safety or personal rights risk to persons in care. Deficient Practice Statement Based on observed, the licensee did not comply with the section cited above in that LPA observed various containers in the front of the home and backyard with water, large planters were leaned against pool fence, and pool fence is in need of repair, which poses/posed a potential health, safety or personal rights risk to persons in care. Staff #1's file is missing the following items: immunization, LIC 9108 - Acknowledgement of Reporting Child Abuse, LIC 508 - Criminal Record Statement, LIC 9052 - Employee's Rights, and Per licensee, she will have staff #1 provide a copy of immunization card and complete the missing forms. These shall be placed in staff #1's file. LPA will conduct a return visit to verify documentation is complete and in the file. LIC 501 - Application.
