101212(a)(d)(1)(C) · 101212 Reporting Requirements: (a) Each licensee or applicant shall furnish to the Department reports as required by the Department including, but not limited to, the following: (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1) Events reported shall include the following: (C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child.
Per CDS Samira facility will submit written report to the Department and will conduct training with staff to review reporting requirements. CDS she will submit training material; staff sign in sheet and agenda to LPA Garcia via email by POC due date 03/10/2023. LPA Garcia’s records review and staff disclosures facility failed to report incident that occurred on 03/13/2023 to the Department within the required 24 hours. 101238(a) · 101238 Buildings and Grounds: (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.
Per Supervisor, a service repair order has been placed on this date and provided LPAs with a copy of the service order. Per Supervisor self-closing latch will be inspected and evaluated for repair to ensure that self-latch is closing and working properly. Based on LPA's observation and Staff #1 disclosure that on March 13, 2023 during outside play time child #1 open the facility gate and ran out of the facility. Staff #1 states, child was able to open door since self-closing latch was not working properly. This poses an immediate health and safety risk to children in care. In addition, the gate intercom pad will also be repair. CD Supervisor will send pictures and video of the repairs to LPA Garcia by POC due date 03/24/23.

Per Supervisor, Staff #1 has been blocked from site. On 02/03/23, staff #1's assignment was canceled and will no longer be accepted when requested by sub services with Child Care Careers. Cancellation request an order was provided in writing to LPAs during visit. Based on LPA Garcia's observation on 02/01/2023 it was determined that the personal rights of Child #1 were violated by Staff #1. This poses an immediate health and safety risk to children in care. Supervisor will provide training to all staff in regard to personal rights and will demonstrate CCLD personal rights video ( https://ccld.childcarevideos.org/child-care-center-operators/childrens-personal-rights-in-child-care/ ) to ensure staff follow Title 22 Regulations. Supervisor will then submit the training agenda, materials and staff sign in attendance for the training to CCLD by or before 04/07/23 in order to clear this citation. Staff #1 was terminated from the facility immediately following the incident. Staff were provided with training on children's safety. A copy of the training topics will be provided to LPA as proof of correction. On 5/02/2022 Staff #1 violated the personal rights of child #1. Staff #2 observed and disclosed the incident.
