101223(a)(3) · 101223-Personal Rights: (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.
Per Teacher, Principal will provided training to all staff in regards to personal rights to ensure that staff is in compliance with Title 22 Regulations. Based on interviews conducted by LPA Mireya Garcia on June 13, 2023 and June 21, 2023, it was determined that the personal rights of Child #1 were violated by Staff #1. This poses a potential health and safety risk to children in care. Per Teacher the Principal will submit via email to LPA Garcia training material, agenda and staff sign in sheet by POC due date 7/5/23, in order to clear this citation. 101212(d)(1)(D) · 101212 Reporting Requirements- (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1) Events reported shall include the following: ... (D) Any suspected physical or psychological abuse of any child.
Per Principal, Xochitl Sanchez, facility will comply with reporting requirements in the future and will submit compliance plan, a copy of training material that was conducted with Staff regarding reporting requirements, personal rights & incident/injury protocols to LPA Garcia via email by POC due date 03/01/2022. LPA's investigation findings reveal that an unusual incident occurred at the facility on December 16, 2021, a day care parent alleges that child #1 disclosed facility staff #1 hurt child.
